The applicant previously provided details of the style of trash <br />enclosure that is being proposed (Exhibit B). <br />13. Provision of the type and size of the three (3) area identification signs. <br />STATUS - (Condition Satisfied). The applicant previously provided details of the style of trash <br />enclosure that is being proposed (Exhibit C). <br />14. Provision of low profile rooftop units painted to match the building's exterior and located <br />such that they will be screened to prevent direct viewing from the public's right-of-way. <br />STATUS - (Pending). This condition is reviewed for compliance during constructiO'n. <br />15. Compliance with the lighting requirements of the Zoning Ordinance. <br />STATUS - (pending). This condition is reviewed for compliance during construction. <br />16. Determination by the City Council that an Environmental Impact Statement is not <br />warranted (negative declaration) or EIS adequacy determination is made. <br />STATUS - (Condition Satisfied). The City Council approved a negative declaration on the <br />need for an EIS with this project. <br />17. Modification of the landscaping as outlined in Findings - Variance #3, item 2. <br />STATUS - (Condition Satisfied). The applicant has upgraded the size of the landscape material <br />. provided along Gateway Boulevard (southwest corner of Phase II) in the area of the parking <br />setback variance as requested by the Staff. <br />18. Modification of the building's exteriors (Phase II, III, and IV) as outlined in Findings - <br />Variance #5, items 2-13. <br />STATUS - (pending). The satisfaction of this condition is dependent on the City Councils <br />acceptance of the proposed modifications to the exterior of the building which is discussed in the <br />Updates section of this memorandum under item nine. <br />19. Modification of the parking spaces to eliminate the variance as outlined in Findings - <br />Other Variances, item 3. <br />STATUS _ (Condition Satisfied). The parking spaces on the northeast corner of Phase II which <br />required a variance have been eliminated from that part of the plan. <br />20. Provision ofthe necessary drainage and utility easements on the plat. <br />STATUS - (pending). The satisfaction of this condition is discussed in the Updates section of <br />this memorandum under item number four. <br />21. Provision of the necessary access easements (Vaughan Towers) on the plat. <br />STATUS _ (Condition Satisfied). The plat shows the required access to the Vaughan property. <br />22. Extension of the relocated 14th Street to the southeastern-most portion of Lot 3. <br />STATUS - (Condition Satisfied). The plat shows the required street extension. <br />23. Payment and/or dedication of park land as recommended by the Parks and Recreation <br />Director. <br />STATUS _ (pending).
