She .. <br />expressed concern that the applicant is running a business in a residential neighborhood, <br /> <br />Commissioner Galatowitsch expressed her surprise that the applicant has been unaware for so <br />many years that City approval is required to run a business of such magnitude. She added, in her <br />opinion, the resident's concerns which were expressed to City staff are well- founded. She noted <br />she would not support the request. <br /> <br />Commissioner Galatowitsch recommended that the applicant relocate her business to the proper <br />zoning district. <br /> <br />Commissioner Duchenes stated, in her opinion, the applicant is fortunate to have the problem of <br />an expanding business with which to contend. She added the applicant's request falls outside of <br />what is permissible in residential zoning. She noted it would be difficult for the Commission to <br />act based on whether the applicant moved her vehicles to off-site parking. She added she would <br />not support the request. <br /> <br />Commissioner Baker expressed his agreement that the request should not be granted. He added <br />the business is being run illegally, with vehicles parked illegally. He noted he would recommend <br />the application be denied. <br /> <br />Commissioner Sand stated the applicant is in violation of zoning requirements which are <br />extensive. He added he would not support the request. He noted the applicant herself had stated e <br />that she has expanded considerably and should find a business location. <br /> <br />Acting Chair Nelson stated the application does not meet the requirements of the City's <br />ordinance. He added he would not support the proposal. <br /> <br />Commissioner Sand requested clarification with regard to cessation of operations if the request <br />were to be denied by the Council. Ms. Chaput stated she would review the situation with the <br />City Attorney prior to the Council's next meeting. <br /> <br />Commissioner Galatowitsch moved, seconded by Commissioner Sand, to recommend denial of <br />Planning Case #00-33, Special Use Permit (Class II Home Occupation) for the operation of a <br />business, Always Wood Flooring, in a single family home, located at 3810 New Brighton Road, <br />since the applicant is unable to meet the following minimum requirements of the Zoning <br />Ordinance for a Class II Home Occupation: <br /> <br />1. <br /> <br />It is noticeable that the property is being used for non-residential purposes due to the <br />number of employee vehicles and work related vehicles on the site; <br />More than one person not residing in the residence is employed to assist in the business <br />activity; and <br />The business is not permitted to have more than two vehicles on-site, in addition to those <br />required by the residents, on a daily basis and this limitation is exceeded. <br /> <br />e <br /> <br />2. <br /> <br />3. <br /> <br />The motion carried unanimously (5-0). <br />
