<br />ARDEN HILLS PLANNING COMMISSION - OCTOBER 4, 2000 <br /> <br />2 <br /> <br />was granted by the City Council in 1983 during the initial platting of the Katie Court arca to <br />anow for a ten-foot reduction in the front yard setbacks of each lot. <br /> <br />e <br /> <br />Procedural Requirements <br />Scction 22-12, (e) of the City Code authorizes the consolidation of platted lots of record if the <br />fonowing four conditions are met: <br />I. The owners of such platted lots to be consolidated shall file with the City Planner a surveyor <br />rcgistered land survey ofthe lots to be consolidated. <br />2. The parcel resulting from the consolidation shall not have an area, dimensions or setbacks <br />which arc less than the minimum requirements spccified for the zoning district in which the <br />parcel is located in the Zoning Ordinance. <br />3. It is detemlined that the proposed consolidation win not be detrimental to thc public welfare <br />or injurious to adj acent tracts in the area in which the consolidated parcel is locatcd. <br />4. The Planning Commission and City Council may attach additional requirements to thc <br />application, as it deems necessary for the protection of the health, safety, general welfare and <br />conyenience of the City. <br /> <br />Zoninl! Review <br />From the above procedural requirements, the fonowing can be determined: <br /> <br />1. All ofthe required documentation was submitted to the City, including a rcgistered survey of <br />the propeliies in question. <br />2. The resulting parcel of the consolidation will exceed an of the minimum dimensional <br />requirements of the City's Zoning Ordinance, as shown in Table I, below. A structure could . <br />also be easily built on the resulting lot, mceting all of the minimum setback requirements. <br />3. The consolidation will not be detrimental to the public or to adjaccnt lands. The purpose of <br />the consolidation is to avoid, during construction on the propeliy, an underground pipeline <br />(possibly filled with concrete) that is rulliling through the propeliy. The consolidation <br />would also give the owners the ability to build a larger single family home by avoiding the <br />easement. <br />4. Staff does not believe that the proposed consolidation will negatively affect the health, safety <br />or general welfare ofresidents in the area. <br /> <br />The properties in question are zoned R-3, Townhouse and Low Density Multiple Dwelling <br />District, which does allow for single family homes as well as a range of other housing types. <br />This area is completely built up with singlc family homes (Exhibit E) and, as such, the City <br />should consider changing the zoning in this area from R-3 to R-l, Single Family Residential, if <br />this is what the City desires in this area. The R-3 district allows for a density of up to 8 units pcr <br />acre and a variety of housing types whereas the R- I allows 3 units per acre and only pemlits <br />single family homes without a land use application. A change in zoning would also preserve the <br />current housing stock as single family and discourage redevelopment of multi-family from <br />occurring in the future. <br /> <br />Ms. Chaput stated that staff recommends approval of Planning Case #00-35, lot consolidation of <br />two parcels, 3295 and 3301 Katie Court, into one parcel, with the following reasons: <br /> <br />e <br /> <br />I. Thc application is able to meet the criteria for consolidation as outlined in Section 22-12, (e) <br />ofthe City Code; <br />2. For future planning purposes, the City will consider rcviewing the zoning for Katie Lane and <br />Katie Court to match what currently exists. <br />
