Ordinance <br />Section VI, A, Accessory Structures <br /> <br />2. Height. No accessory structures shall exceed the height of the principal structure to <br />which it is accessory. <br /> <br />3. Location. No accessory structures in the R-1 or R-2 Districts shall be located nearer thc <br />front lot line than the front yard setback line for the principal structure to which it is <br />accessory. Accessory structures as permitted and regulated in this ordinance may be <br />located within the rear yard of the principal structure. <br /> <br />5. Size. In R-1 and R-2 Districts, no accessory structure shall exceed seven hundred twenty- <br />eight (728) square feet in floor area and for accessory structures located in thc rear yard of <br />a principal structure, the total floor area of all such accessOlY structures shall not exceed <br />twenty-five (25) percent of the minimum required rear yard area for the principal <br />structurc. <br /> <br />Two gazebos are being proposed: a 26' gazebo (Williamsburg Pagoda) on the northwesterly sidc <br />of the principal structure and a 12' x 14' gazebo (Victorian Oval) on the southwesterly side. The <br />Williamsburg gazebo is approximately 676 square feet in area whereas the Victorian is 168 <br />square feet. The gazebos are considered accessory to the principal stmcturc on the property and <br />are, therefore, bcing evaluated according to accessory structure regulations. <br /> <br />Currently, the Zoning Ordinance does not limit the numbcr of accessory stmctures on a property. <br />Therefore, the addition of two is permitted. They also do not exceed the height of the principal <br />structure, nor do they exceed the hcight permitted by the Zoning Ordinance of35'. The gazebos <br />are located in the side yard of the property and are not proposed to be located within the front <br />yard setback of the principal building. The Zoning Ordinance states that accessory structures <br />are permitted in the rear yard and within any area that is not nearer the front lot line than the front <br />yard setback line for the principal structure to which it is accessory. The gazebos, although <br />located on the side yard of the property, are actually to the rear of the principal building. <br /> <br />The setback for accessory structures for within either the side yard or the rear yard is 10'. The <br />proposed positioning of the gazebos exceed this considerably. The Williamsburg is <br />approximately 223' (-30' from the principal building) and the Victorian is 94' (-112 from the <br />building) from the side lot line according to the property survey. Also, the areas of both <br />gazebos are less than the maximum area permitted for an accessory stmcture. <br /> <br />The proposed gazebos meet all of the minimum requirements for accessory structures outlined in <br />the City of Arden Hills' Zoning Ordinance. <br /> <br />Ms. Chaput stated that staff recommends approval of a Planned Unit Development amendment to <br />North Heights Lutheran Church, located at 1700 Highway 96, for the addition of two accessory <br />structures (gazebos) on the southwest portion of the property, as outlined in the submitted plans, <br />with the following conditions: <br /> <br />1. Application for a building permit must be made with the Building Inspector prior to <br />constmction. <br />
