He closed the public hearing at 8:40 p.m. <br /> <br />Commissioner Sand stated he was disappointed as he had wished to commend the applicant on <br />their signage proposal and site plan, Ms, Chaput stated the property has a new owner who may <br />wish to review the site plan which may be presented again at a future date, <br /> <br />PLANNING CASE # 00-41 - CITY OF ARDEN HILLS - ZONING ORDINANCE <br />AMENDMENT (NB DISTRICT LANGUAGE) SECTION 5 (E) AND (m #3 - PUBLIC <br />HEARING <br /> <br />Chair Erickson opened the public hearing at 8:41 p.m. <br /> <br />Ms, Chaput explained that the City of Arden Hills requests that Section 5 (E) and (H) #3 of the <br />Zoning Ordinance #291 be amended to allow multiple family dwelling units in the neighborhood <br />business district, with restrictions, <br /> <br />. <br /> <br />Ms. Chaput stated that on September 27, 1999 (Planning Case #99-04), the language for a new <br />zoning district, the neighborhood business district, was adopted by the City Council and inserted <br />into the City's Zoning Ordinance, She added that while reviewing the proposed rezoning for <br />seven groups of properties for this district at the November 1,2000 meeting (Planning Case #00- <br />38), the Planning Commission recognized that the neighborhood business district language did <br />not permit any types of dwelling units. She noted that the Planning Commission directed staff to <br />propose an ordinance amendment for the December meeting, addressing this issue. <br /> <br />Ms, Chaput stated that this issue was also raised at the November 27,2000 City Council <br />meeting. She added the City Council unanimously approved the change in zoning of the seven <br />groups of properties to neighborhood business, as recommended by the Planning Commission. <br />She noted that there was some concern about the limitations of the district language since <br />dwelling units are not permitted. Staff informed the City Council that the Planning Commission <br />would be reviewing this issue at the December 6, 2000 meeting. <br /> <br />Ms, Chaput stated that the Zoning Ordinance lists a number of different dwelling types that are <br />permitted in various districts of the City, She added the purpose of the neighborhood business <br />district is to promote pedestrian fiiendly, mixed-use environments, similar to the popular <br />planning concept of new urbanism. She noted this type of district should encourage live/work <br />environments within it. <br /> <br />Ms, Chaput stated that multiple family dwelling units are typically the more appropriate dwelling <br />type to locate above a business in a district such as this. She added that since this is a business <br />district, some restrictions should be placed on permitting dwelling units as a sole use on a <br />property. She noted, as an example, that dwelling units should be mixed with a business use to <br />ensure that the use continues to meet the intent of the district and the City's Comprehensive Plan. <br /> <br />e <br /> <br />Ms. Chaput stated that the neighborhood business district does not currently permit any types of <br />dwelling units, She added that all of the dwelling unit types and their corresponding district <br />regulations are shown in the "Dwelling" section of the Land Use Chart, Section 5 (E), of the <br />Staff memo, She noted that staff proposes that "Multiple Family" dwellings be allowed in the <br />neighborhood business district through a special use permit. <br />
