<br />, <br /> <br />Memorandum ~ Lake Johanna Surface Use Ordinance <br />June 27,2001 <br />Page 2 <br /> <br />e <br /> <br />The City Attorney and City staff agree that the City should change the language in section 12-19 <br />to make it permissive rather than mandatory to place buoys in the lake and enforce the 250 foot, <br />5 m.p.h. speed zone from shore. Eliminating the language and not having the ability at some <br />point in the future to enforce those regulations means having to go through process of <br />renotification and language change to the ordinance at that time. If the City Council is in favor <br />of the language as proposed, the Council will need to pass the ordinance at a public hearing and <br />pass along their changes to the Department of Natural Resources (DNR) for their review and <br />approval. The changes do not become effective until approval from the DNR. Kim Elverum of <br />the DNR received a copy of the proposed changes for his review. He made minor comments and <br />has indicated to me that based upon the minor change to the ordinance it would take the DNR <br />approximately 2-3 weeks to circulate the changes and get final approval. At that time the City <br />should publish the ordinance with the changes as approved by the DNR. <br /> <br />Recommendation <br />City staff recommends the City Council approve Ordinance 330, an Ordinance relating to Lake <br />Surface Use Regulations, Amending Article 2, Division 1, Sections 12-16 through 12-19 and <br />Article 2, Division 2, Sections 12-27 and 12-32. Staff further recommends that the City Council <br />direct City staff to forward the changes to the DNR for their review and approval and publication .. <br />upon acceptance by the DNR. ,., <br /> <br />e <br />
