The Assistant AG's opinion was that the
DNR surface use rules require that any ordinance originating prior to
1975 needs to be brought into compliance with the standards adopted in
those 1980 rules, unless a variance is requested. The 100 or 1501 from
shore slow-no wake portion was what he was pointing out. If there is a
variance frornthat (IE the 250' that you folks have) - he thought a
request for variance should be made by the City to cover that portion.
If that were done - it appears that we have no problem in approving the . f _

ordinance amendment as proposed. 1,4!MI/flh fi)_...k.~ LAJ ~ ~~.

Hope that helps I '-'I""'{ '-'V"1' -I 0 1'(1'7

Kim

>>> <joe.1ynch@ci.arden-hi11s.mn.us> 09/04/01 01:42PM >>>
Kim:

I have passed along your e-mail to our Council to get feedback on the
_~eq~est for variance. I would again like to ask why it is that we need

.varlance whne we are not changing that portion of our Ordinance having
to do
with the setback area? I though I understood from you that we would not
have to make changes to other parts of our Ordinance, which is legal and
adopted before DNR regulations, if we were not changing those portions
of
the Ordinance.

Joe Lynch
City Administrator
City of Arden Hills
65)-634-5127

-----Original Message-----
From: Kim Elverurn [mailto:kim.elverurn@dnr.state.rnn.us]
Sent: Monday, August 27, 2001 2:33 PM
To: joe.lynch@ci.arden-hills.mn.us
Subject: Lake Johanna

Our Assistant AG feels that the City should request some sort of
variance
from our standard
According to him,
counties to bring
were
_enacted prior to 1975.

.If you could fax or mail me something to the following, I think that
would
cover the variance request:

100 or 150 foot
our surface use
ordinances into

for shoreline slow-no wake zones.
rules appear to require cities and
line with the rules standards if they

1
