<br />Memorandum, Recodification <br />November 16,2001 <br /> <br />Staff will also-incorporate-newly adopted ordinances (mostly during 2001), and/or <br />appendices as appropriate <br /> <br />A question to consider is the process the Council uses for public information, when <br />adopting new ordinances, which in turn become part of the City's code. Does the City <br />Council wish to hold a public hearing prior to adoption of the entire Code of Ordinances? <br />Note in City Attorney Filla's letter of October 26,2001, his reference to the votes needed <br />for approval of both the Ordinance and the Summary. <br /> <br />Staff has researched, and included in this packet, Minnesota Statute regarding ordinance <br />adoption by municipalities. <br /> <br />For those recent changes made as part of a Planning Case (i.e., Right-of- Way; <br />Floodplain; Signs), a public hearing is held by the Planning Commission as part of the <br />process. All newly-enacted ordinances and/or amendments would not necessarily <br />involve the Planning process. Does the City wish to amend its Code of Ordinances by <br />simple publication of the ordinance summary? After adoption, we can use various <br />resources to inform our residents and the public by inclusion on the website; newsletter <br />summaries and any other means as directed. <br /> <br />Staff is enclosing an excerpt from the League of Minnesota Cities handbook regarding <br />resolutions and ordinances and their respective processes. Council may wish to direct <br />staff on an alternative policy for adoption if preferred. <br /> <br />Existing Code ofOrdinances/Aooendices <br />The draft ordinance addresses the repeal of past ordinances. <br /> <br />There are several areas, (i.e., personnel policy; adult uses; zoning; signs; flood plain <br />management; shore land management; cable communication franchise; gas distribution <br />franchise; and electrical distribution franchise) that need to be continued in the <br />"Appendix" section of the Code of Ordinances. <br /> <br />The Personnel Ordinance is the only standing policy we have at this time to protect the <br />City from potential litigation prior to the adoption of a formal Personnel Policy. Specific <br />language to continue these various items on an interim basis will need to be confirmed by <br />City Attorney Filla. <br /> <br />Fee Resolution <br />Staff needs to verify that the Code of Ordinances does not include fees to be charged, but <br />references the annual resolution entitled, "A Resolution Establishing the Fee Schedule for <br />(year).
