<br />.' <br /> <br />. <br /> <br />~ <br />~~HILLS <br /> <br />CITY OF ARDEN HILLS <br /> <br />MEMORANDUM <br /> <br />DATE: May 7,2002 <br /> <br />TO: Mayor and City Council <br />City Administrator Joe Lynch <br /> <br />FROM: Aaron Parrish, City Planner fil <br /> <br />SUBJECT: Case #02-06 <br />Pilgrim House Unitarian Church <br />Special Use Permit Amendment <br /> <br />Reauest <br /> <br />. <br /> <br />The applicant is requesting an amendment to their existing Special Use Permit to <br />allow a daycare facility at Pilgrim House. <br /> <br />Backaround <br /> <br />As the Council may recall, this item was considered at the April 29, 2002 meeting <br />of the City Council. In discussion with the City Attorney, and based on additional <br />staff review, two additional pieces of information were presented at the meeting. <br />First, State law currently allows daycares of 12 or less in the R-1 Zoning District. <br />Our zoning ordinance only allows 10 or less. We cannot be more restrictive than <br />State law. In short, a daycare could operate at Pilgrim House if 12 or less <br />children were served. <br /> <br />Second, and more importantly, staff found the following language in the City <br />Code relative to daycare facilities and houses of worship: <br /> <br />Arden Hills Zoning Ordinance, Section 6, B, 2 Accessory Uses <br /> <br />. <br /> <br />Day Care Facilities for Houses of Worship and Schools. Day care <br />facilities for over ten (10) persons shall be considered as accessory uses <br />for houses of worship and schools within all residential districts if located <br />in the principal building. <br />
