.'

.

~
~~HILLS

CITY OF ARDEN HILLS

MEMORANDUM

DATE: May 7,2002

TO: Mayor and City Council
City Administrator Joe Lynch

FROM: Aaron Parrish, City Planner fil

SUBJECT: Case #02-06
Pilgrim House Unitarian Church
Special Use Permit Amendment

Reauest

.

The applicant is requesting an amendment to their existing Special Use Permit to
allow a daycare facility at Pilgrim House.

Backaround

As the Council may recall, this item was considered at the April 29, 2002 meeting
of the City Council. In discussion with the City Attorney, and based on additional
staff review, two additional pieces of information were presented at the meeting.
First, State law currently allows daycares of 12 or less in the R-1 Zoning District.
Our zoning ordinance only allows 10 or less. We cannot be more restrictive than
State law. In short, a daycare could operate at Pilgrim House if 12 or less
children were served.

Second, and more importantly, staff found the following language in the City
Code relative to daycare facilities and houses of worship:

Arden Hills Zoning Ordinance, Section 6, B, 2 Accessory Uses

.

Day Care Facilities for Houses of Worship and Schools. Day care
facilities for over ten (10) persons shall be considered as accessory uses
for houses of worship and schools within all residential districts if located
in the principal building.
