<br />. <br /> <br />. <br /> <br />. <br /> <br />RESOLUTION <br /> <br />RICE CREEK WATERSHED DISTRICT <br />BOARD OF MANAGERS <br />RESOLUTION TO APPROVE CITY OF ARDEN HILLS <br />LOCAl, WATER MANAGEMENT PLAN <br /> <br />Manager Haake offered the following Resolution and moved its adoption, <br />seconded by Manager Aiken: <br /> <br />WHEREAS on June 14,2000, the RCWD adopted amendments to its Water Resource <br />Management Plan (WRMP) under Minnesota Statutes !i I 03B.23 I , which, as amended, details <br />the existing physical environment, land use and development in the watershed and establishes a <br />plan to manage water resources and regulate water resource use to improve water quality, <br />prevent flooding and otherwise achieve the goals of Mil me sot a Statutes Chapters 103B and <br />103D; <br /> <br />WHEREAS the WRMP, as amended, incorporates the Rules adopted by the RCWD to <br />improve water quality, prevent flooding and otherwise achieve the goals of Minnesota Statutes <br />Chapters 103B and I03D; <br /> <br />WHEREAS on September 27,2001, the City of Arden Hills ("City") submitted a draft <br />local water management plan under Mimlesota Statutes S 1 03B.235 for RCWD review; <br /> <br />WHEREAS the Metropolitan Council received a copy of the draft local plan and <br />provided comments on that plan to the RCWD on November 5, 2001; <br /> <br />WHEREAS the RCWD reviewed the local plan in accordance with Minnesota Statutes <br />S103B.235, subd. 3, and responded in writing to the City on November 26,2001 and April 4, <br />2002, and the City submitted a final local plan to the RCWD on June 26, 2002 (the "Plan"); <br /> <br />WHEREAS that area within City boundaries occupied by the Twin Cities Army <br />Ammunition Plant (TCAAP) is not addressed by the local plan, but the City agrees to amend the <br />local plan to do so once TCAAP land is transferred out offederal hands and available for local <br />planning and development; <br /> <br />WHEREAS the RCWD has determined that the local plan otherwise meets the <br />requirements for approval set forth in the WRMP, except that the local plan does not provide for <br />the adoption of official controls or implementation of inspection and administrative procedures <br />nccessary to insure that the full regulatory standards of the RCWD are met, as required by the <br />WRMP in order for the City to assume sole regulatory authority; <br /> <br />WHEREAS the City does not wish to assume sole regulatory authority but, instead, <br />wishes to authorize thc RCWD to continue to require permits for the use and development of <br />land, and otherwise exercise its regulatory authority within the City, within the meaning of <br />Minnesota Statutes SI03B.211, subd. l(a)(3); and <br />
