<br />. <br /> <br />. <br /> <br />. <br /> <br />Memo to Planning Conunission <br />Planning Case #02-31 <br />Page 5 of6 <br />in approximately the same location as the garage that was destroyed by a fire. <br />The current owner was also not involved with the construction or placement of <br /> <br />the house, which due to its location, could cause problems for vehicles attempting <br />to access the eastern half of the garage ifthe garage were constructed at the <br />required side yard interior setback. <br /> <br />5. Would granting the variance alter the essential character of the <br />neighborhood? <br /> <br />No. The effect of the garage should not alter the character ofthis neighborhood. <br />Furthermore, the Zoning Ordinance allows principal buildings and attached <br />garages to be constructed at the distance the applicant is requesting. <br /> <br />6. Is the variance requested the minimum variance necessary? <br /> <br />Yes. The variance of five feet will allow the applicant to construct the garage five <br />feet from the west property line and prevent the applicant from having to relocate <br />a portion of their driveway. <br /> <br />Deadline for Al!encv Actions <br /> <br />The City of Arden Hills received the completed application for this request on October <br />28, 2002. Pursuant to Minnesota State Statue, the city must act on this request by <br />December 27, 2002 (60 days), unless the City provides the petitioner with written reasons <br />for an additional 60 day review period. The city may with the petitioner's consent extend <br />the review period beyond the 120 days. <br /> <br />Options <br /> <br />I. Recommend approval as submitted. <br />2. Reconunend approval with conditions. <br />3. Reconunend deniaL If the City denies the petitioner's request, "... it must <br />state in writing the reasons for the denial at the time that it denies the request". <br />4.
