City Requirements <br /> <br />Section VIII, D, 4, c and d, of the City's Zoning Ordinance state that, <br /> <br />"Adherence to the provisions of this ordinance is required, except for special cases which <br />arise because of the configuration of a particular parcel. The condition shall not have <br />been created by the landowner. A variance or variances may be granted from specific <br />provisions of this ordinance beca1,lSe such land factors as length of a side of a lot, the <br />shape of the lot or the unusual terrain prohibit reasonable development equivalent to that <br />which would be permitted without variance on a similar size lot located in the same <br />diStrict, but which lot has no unusual configuration. Economic conditions alone shall not <br />be grounds for a variance. In no case shall the granting of a variance impair the health, <br />safety, comfort and general welfare of the public, nor will it be contrary to the intent and <br />purpose ofthe Comprehensive Plan, the official map or this or any other ordinance of the <br />City." <br /> <br />Variance Findinl!:s <br /> <br />Minnesota State Stature 462357, subd. 6, requires that Cities consider the following five <br />matters when hearing requests for zoning ordinance variances, <br /> <br />. <br /> <br />1. Are the circumstances for which the variance is requested unique to the <br />property? <br /> <br />No. The house was built in 1954 and currently only has a one car garage, The <br />dimensions of the lot are fairly standard for Glen Arden Road, 80 feet by 200 feet. <br />Staff conducted a windshield survey of the neighborhood noted approximately 3 <br />properties along Glen Arden Road that have a one car garage, The 3538 Glen <br />Arden property has approximately 31 feet between the current garage and the <br />house to the north; whereas the other two properties with single car garages are <br />much to close to the adjacent homes or garages to build an attached two car <br />garage (they may be able to construct a detached two car garage). The applicant's <br />property was developed in the 1950's with the one-car garage built right up to the <br />minimum side yard setback. This particular neighborhood was likely one of the <br />first areas in Arden Hills to be developed, While this situation may not be <br />common to other areas of the City it is not altogether uncommon in other areas <br />which developed around the same time. <br /> <br />. <br /> <br />PC #03-{)9 - PC Report 03/27/03 - Page 3 of6 <br />
