<br />. <br /> <br />. <br /> <br />. <br /> <br />· The City will not damage the Association's bridges, picnic table; signage or wooden <br />posts. If said items are damaged due to the construction of the project, the City, at its <br />expense, shall return the items to their original conditions. <br />· The City agrees that the current configuration or width of the Fernwood Channel will <br />not be changed so as that the existing bridges are not able to be realigned in their <br />current configuration and/or reinstalled so as they provide the same function post <br />construction as they do preconstruction of the project. If the City needs to move <br />either bridges in order to perform the requested project work, the City will be <br />responsible for the work and expense incurred in moving said bridges and reinstalling <br />and realigning the bridges to their current configuration. <br />· The City agrees that post construction, all of the Association's land will be returned <br />to its original condition if not better. All construction debris will be removed from <br />the property at the City's expense. <br />· The City guarantees that the project will not worsen any natural flooding of the <br />Association property. <br />· The Association property will be accessible to the Association members during a <br />large percentage of the project. The only time during the project that Association <br />members will not be able to access the property is during the excavation and <br />seeding/ sodding/landscaping. <br />· As requested by the City, the Association will grant the City two (2) temporary <br />easements: <br />· A temporary construction easement over the entire Association property in order <br />to do the proposed work. The maximum duration of this temporary easement <br />would extend from June 20, 2003 to October 31,2003. The City will ensure that <br />Association members have access to Lake Josephine throughout the construction <br />process via either Femwood Court or Ingerson Court. <br />· A temporary one-time easement, near the close of the project, to remove <br />approximately 1-2 feet of silt and construction debris from the existing Fernwood <br />Channel between Lake Josephine and the new basin. The City will not expand <br />the Fernwood Channel during this process and could even narrow the Femwood <br />Channel in places as approved by the Association. Edges will be rounded and <br />biodegradable turf blankets will be installed to stabilize the slopes. Other <br />disturbed areas will be seeded or sodded as necessary. The maximum duration of <br />this temporary easement would extend from June 20, 2003 to October 31, 2003. <br />· Upon completion of the project, the Association will grant the City the following <br />combined drainage and utility permanent easement: <br />· An easement that would cover the proposed french drain north of the existing <br />watermain easement for a total of no more than 300 square feet. The easement <br />terms will allow the City only access to inspect/fix/maintain/clean the french <br />drain as necessary to insure it is functioning as proposed. The easement will not <br />allow the public at large access to the site. <br />. An easement that would cover the basin area from the boulder weir to the City's <br />property line and would consist of a maximum of 5200 square feet. The easement <br />terms would allow the City only access to inspect/fixlmaintain/c1ean the basin and <br />boulder weir as necessary to insure that they are functioning as intended.
