<br />.. ... <br /> <br />applicant has stated that the trees would come for the Ramsey County's Workbouse . <br />program has a nursery where County would be able to get trees at a lower cost; however, <br />their largest trees are 2,5 caliper inches in diameter. The applicant has cited the reasons <br />for requesting the variance are: the productive use of inmate labor, a cost savings to the <br />taxpayers and the Public Works Facility partners, and additional trees (at the 2-3 caliper <br />inch category) above the City's requirements would be provided, Second, in response to <br />condition 6, the applicant has provided a revised layout for the Sheriff Station parking lot <br />(eastern most parking lot along the access drive). An 8 Y:, by 11 copy ofthis layout has <br />been included as an attachment. Staff has reviewed the layout and feels that the revisions <br />shottld alleviate any concerns about the parking lot access, <br />.;-t:'f!,: <br /> <br />Planninl! Commission Determination and Recommendation <br /> <br />A. Determination: The Planning Commission made a determination that in <br />reviewing the proposed amendment to the Special Use Permit, the Commission <br />considered the effect of the proposed use upon the health, safety, convenience and <br />general welfare of the owners and occupants of surrounding land, in particular, <br />and the community as a whole and that that the facts and circumstances ofthe <br />particular case warranted granting of the amendment to the Special Use Permit. <br /> <br />B. <br /> <br />Conditions of Approval: Following the determination, the Planning <br />Commission recommended approval ofthe amendment to the Special Use Permit <br />subject to the following conditions as the Commission deemed necessary to serve <br />and protect the health, safety, convenience, and general welfare of the <br />community, <br /> <br />. <br /> <br />I. <br /> <br />All necessary building permits shall be filed with the City Building <br />Official. <br />All necessary signage permits shall be filed with the City Planner. <br />The number of handicapped accessible parking spaces shall comply with <br />the State Building Code requirements, <br />The applicant shall submit a revised landscape plan and planting schedule <br />which complies with the City's landscaping requirements for the required <br />caliper inches of trees; such plans shall be submitted to the City Planner <br />for approval prior to the issuance of a Certificate of Occupancy, <br />The applicant shall submit, prior to the issuance of a Certificate of <br />Occupancy, a landscape performance bond or other surety for 125% of the <br />cost of materials and installation valid one full year from the date of <br />installation. <br />The applicant shall either remove the southern parking lot entrance to the <br />Sheriff Patrol Station parking lot or relocate it to the east side of the <br />parking lot. The applicant shall provide such design changes on a revised <br />site plan which shall be submitted to the City for review by the City <br />Planner, City Engineer, Building Official, and Fire Marshall for their <br />approval prior to the issuance of a Building Permit. <br /> <br />. <br /> <br />2. <br />3. <br /> <br />4, <br /> <br />5, <br /> <br />6, <br /> <br />PC #03-26 - CC Report 10/27/03 - Page 2 of3 <br />
