The City Code <br />(Shoreland Ordinance) in Section 20.5-41, states that the minimum building setback <br />shall be 150 feet from the Ordinary High Watermark (Valentine Lake). All of the <br />proposed structures exceed this requirement. <br /> <br />9. Landscape Plan. The landscape plan includes additional trees along the tennis <br />courts and parking area. The pines proposed along the tennis courts range from 7 to 9 <br />feet in height. Staff would recommend adding an additional 6 pines at 45 degree <br />angles to each other on the City property to screen the parking lot from the resident~. <br />These should be placed just to the east of the 7 pinkspire crabapples. <br /> <br />10. Parking Setbacks. The Zoning Ordinance in Section VI, F, d, (4) and (5), state that <br />the minimum parking setback is 20 feet from any right-of-way line and 5 feet to any <br />other property line~ The City Code (Shoreland Ordinance) in Section 20.5-43, (I) and <br />(2), states where feasible and practical the parking setback shall be the structure <br />setback (150 feet) and in no instance shall the parking setback be less than 50 feet <br />from the Ordinary High Watermark (Valentine Lake). It would appear that all <br />parking area additions would meet both the requirements of the Zoning Ordinance <br />and the Shoreland Management Ordinance. <br /> <br />11. Grading. The applicant obtained Rice Creek Watershed District (RCWD approval <br />December 22, 1999 (Exhibit E 112). <br /> <br />12. Student Population. The Special Use Permit (78-5) includes a condition (#5) which <br />states; "The resident population of the campus shall not exceed the population <br />anticipated for high density (approximately 12 dwelling units per acre) residential <br />development of the site (approximately 2300 persons)". This proposal should not <br />change the number of students~ <br /> <br />13. Shoreland. The subject property is located in the Shoreland Management area, per <br />the Minnesota Department of Natural Resources (DNR).The City Code in Chapter <br />20.5-22, Subpart 12, a, defines Shoreland as land located within 1,000 feet from the <br />ordinary high water mark oflake, pond, or flowage. The subject property is within <br />1,000 feet of Valentine Lake, a DNR protected water. <br /> <br />The City Code in Chapter 20.5-47, (a), (I), permits the selective removal of natural <br />vegetation, provided that sufficient vegetative cover remains to screen cars, <br />dwellings, and other structures when viewed from the water. Therefore, if this <br />proposal were to comply with the intent of the Shoreland Management regulations, <br />then the maintcnance of a vegetative buffer is required between this use and <br />Valentine Lake. <br /> <br />The City Code in Chapter 20.5-47, (b), allows for grading and excavation in <br />shore land areas. If a permit is granted to grade and excavate in a shoreland area, then <br />the permit is required to be conditioned on the following: <br />
