Pursuant to Minnesota State Statue the City must act on this request by April 15, <br />2001{60 days), unless the City provides the petitioner with written reasons for an additional <br />60 day review period. The additional review period would extend to June 14,2001. The <br />City may, with the petitioner's consent, extend the review period beyond the JlUle 14, 2001 <br />date. <br /> <br />Lastly, if the City denies the petitioner's request, "... it must state in writing the reason for <br />the denial at the time that it denies the request" <br /> <br />Options <br />1. Recommend approval as submitted. <br />2. Recommend approval with conditions. <br />3. Recommend denial with reasons for denial. <br />4. Table for additional information. <br /> <br />Recommendations <br />Staff recommends approval of a Master Planned Unit Development of the properties <br />located in the Northeast quadrant ofI-694 and 1-35W, with the following conditions: <br /> <br />1. The identified uses in the Design Standards must state that: antennas are only <br />permitted as special accessory uses; no outdoor storage will be permitted; and <br />dayeares (with less than ten children) and drive-thrus are allowed as an accessory use; <br />2. Maximum office component requirement be increased from 50% to 100% as per the <br />"Variance Requests and Findings, {aY' section of the staffmemorandum; <br />3. Minimum building size be reduced from 20,000 square feet to 6,000 square feet as <br />per the "Variance Requests and Findings, (b)" section of the staff memorandum; <br />4. Maximum building height be increased from 35 feet to eight stories as per the <br />"Variance Requests and Findings, (c)" section ofthe staff memorandum; <br />5. Parking ramps/decks be permitted within the front yard setback (IO' where not <br />currently permitted) and the side yard/corner setback (20' whcre not currently <br />permitted) as per the "Variance Requests and Findings, (d)" section of the staff <br />memorandum; <br />6. Side yard setbacks for the principal structure{s) be decreased to 10' on the interior <br />(where 20' is required) and 20' on the corner (where 50' is required) as per the <br />"Variance Requests and Findings, (e)" scction of the staff memorandum; <br />7. Reducing the specific landscape requirements (caliper inches) outlined in Appendix <br />A, Zoning Ordinance, relating to the square footage of floors of a building and <br />building height to reflect the proposed requirements in the applicant's Design <br /> <br />9 <br />
