Herrick moved that the Counci I concur with Engineer Lund's recom- <br />mendation to not abate the assessment; seconded by E. G. Henderson. <br />Motion carried unanimously. <br /> <br />REPORT OF COUNCILMAN JOHN HOLLENHORST - Planning and Zoning <br /> <br />Absent. Report given by R. Schumacher. <br /> <br />. <br /> <br />Case No. 71-9, Bethel COllege Academic Buildings <br />R. Schumacher described the Bethel College five-building construction <br />proposal presented to the Planning Commission, and advised the Council <br />that the Planning Commission recommends: <br />I. Approval of the design concept, as presented. <br />2. Approval of proceeding with footing construction, as requested, <br />requesting that building plans be presented for approval as <br />they are completed for each building. <br />3. Withholding certificates of occupancy until the landscape <br />plans are approved. <br /> <br />R. Herrick moved that the Council concur with the Planning Commission's <br />recommendations, as outl ined; seconded by S. Olmen. <br /> <br />After discussion, R. Herrick amended his motion, adding that no approval <br />of ingress or egress to the campus from Old Highway 10 Is included <br />In the approval granted at this time; seconded by S. Olmen. <br /> <br />Motion on the amended motion carried unanimously. <br /> <br />Motion on the original motion carried unanimously. <br /> <br />Case No. 71-11, R. Luehrs - Variance Request <br />R. Schumacher advised the Council that this variance was granted by <br />the Council on August 13, 1969, but the garage was not constructed at <br />that time; Mr. Luehrs Is again requesting to build the garage seven <br />feet (7') from the side lot line; the Board of Appeals and Planning <br />Commission recommend that the Counci I approve the variance, as re- <br />quested. <br /> <br />R. Herrick moved that the Council concur with the Board of Appeals <br />and Planning Commission recommendations to approve the variance; <br />seconded by E. G. Henderson. Motion carried unanimously. <br /> <br />Case No. 71-12, Excavation Permit Request - Joe Bussard <br />S. Olmen moved that the Council approve Permit No. 71-3, to excavate <br />5000 cu. yds. of clay from the area south of 4335 N. Highway 10, as <br />recommended by the Planning Commission; area to be "dressed" after <br />removal of the clay to prevent erosion; required bond to be posted. <br />with the Building Inspector. The motion was seconded by E. G. Hender- <br />son and carried unanimously. <br /> <br />. <br /> <br />Case No. 71-13, Fill Permit Request - W. L. MII:t2.!!. <br />R. Schumacher advised that the Planning Commission recommends approval <br />of Fill Permit No. 71-4, permitting 1000 cu. yds. of sand, clay and <br />concrete fill on property owned by W. L, Milton on Cleveland Avenue, <br />about 1500 feet south of County Road E2; concrote to be covered with <br />I foot of so I I . <br /> <br />S. Olmen moved that'the matter be tabled until Engineer Lund and <br />Maintenance Supervisor Beecher determine that natural drainage will <br />not be interrupted by permitting the fill, as requested; seconded by <br />R. Herrick. The motion carried unanimously. <br /> <br />Case No. 70-33, Swimming Pool Ordinance. <br />R. Schumacher advised that the Planning Commission recommends Councl I <br />approval of the Swimming Pool Ordinance as amended by the Planning <br />Commission on Apri I 27, 1971. <br /> <br />R. Herrick moved that the Council waive the second reading require- <br />ment and give the ordinance Its final reading, approving AN ORDINANCE <br />REGULATING CONSTRUCTION, PLACEMENT AND OPERATION OF PRIVATELY OWNED <br />SWIMMING POOLS IN THE VILLAGE OF ARDEN HILLS, COUNTY OF RAMSEY, STATE <br />OF MINNESOTA: seconded by S.
