MotIon carried unanImously. <br /> <br />Calph-Northdale Construction Co~pany Claim <br />Attorney Cou rtney rev I ewed the s-;"atus o-f the Ca I ph-Northda I e Construc- <br />tion Company claim and recommended that the Village continue to <br />withhold the $4500.00, at least ~emporarily, and await action. <br /> <br />. <br /> <br />The Counci I agreed to the Attorney's recommendation and requested <br />Attorney Courtney to advise the attorneys for Calph and Northdale <br />Construction Company of the Council's action. <br /> <br />1.0.O.F. - S~ecial Use Permit Statu~ <br />ffiOrney Courtney reviewed a letter and affadavit received from the <br />attorney for I.O.O.F., dated January 21, i971, referring the Council <br />to his letter of February I, 1971, In which he Indicates there Is no <br />need for a new applIcation and recommends that a Special Use Permit <br />be prepared. <br /> <br />Attorney Courtney and Pianner Richard Shetler were requested to <br />cooperatively prepare a Special Use Permit draft for Council consid- <br />eration on February 22, 1971. <br /> <br />Clerk Administrator Stromquist was requested to provide the Council <br />with cop I es of Attorney Courtney's I etter of December 28, 1970. <br /> <br />Prel iminary Project Costs <br />Attorney Courtney referred the Council to his letter of February 8, 1911 <br />and recommended that consideration be given to increased Special Use <br />Permit fees to more adequately cover costs involved. <br /> <br />Clerk Administrator Stromquist was requested to check into fees <br />charged by other villages. <br /> <br />Arden Hills-New Brlqhton Land Trade Status <br />Attorney Courtney advised the Council that the Munlcipai <br />Is waiting for Information from the Highway Department. <br />will "keep in touch" with New Drlghton and the Municipal <br />and advise the Council of the status of the matter. <br /> <br />CommIssion <br />He said he <br />Commission <br /> <br />Attorney Courtney advised the Council of a $25.00 fee requested by the <br />Municipal Commission, which the Council authorized him to pay. <br /> <br />HUD Grant <br /> <br />Amended Cont~ct - Attorney Courtney advised the Council that <br />because of a typographical error in the amended contract from <br />HUD, a new contract wi II be submitted. <br /> <br />. <br /> <br />Audl~ of the Prolect - Counci Iman Henderson moved that Clerk <br />Administrator Stromquist be authorized to notify George M. <br />Hansen Company to conduct the audit of the HUD project and to <br />notify HUD of the Council's ~ction; seconded by Councilman <br />Herrick. Motion carried unanimOUSly. <br /> <br />Raymond Wa~ner Plat <br />Councilman Hollenhorst advised the Council that the Planning Commission <br />reviewed the Prel imlnary Plat, and determined that the plat is in order <br />as presented by Mr. Wagner; set the date for Public Hearing on March 2, <br />i971, subject to the opinion of Attorney Courtney. <br /> <br />Mr. Courtney's letter, dated February 3, 1911, re the matter was re- <br />viewed. <br /> <br />After discussion, Councilman Hol lenhorst moved that the Council grant a <br />variance from the regulations under Section 13, Ordinance 98, waiving <br />the PUblic Hearing requirement and approving the Preliminary and Final <br />Plat, as presented.
