The 2007 land market value according to Ramsey County rccords is $625,500 <br /> (thc applicant can submit an independcnt appraised value of the lots to re-calculate the <br /> park dedication fee). Bascd on the Ramsey County assessed value, the maximum park <br /> dedication fee for the entirc property would be $37,530 or S 12,5 10 pcr lot. However, the <br /> City can only charge far the two additional lots created in the plat. Excluding the one <br /> existing lot would set the park dedication fee for the two new lots at a maximum of <br /> S25,020. <br /> The applicants can submit an official appraisal I()r Lots 2 and 3, which may set a more <br /> accurate park dedication fee. <br /> Although the subdivision ordinance provides a guide for calculating the park dedication <br /> fee, the City Council does have the discretion to reduce the park dedication fec if the <br /> circumstances walTant a reduction. For examplc, State Statutes require the City to give <br /> due consideration to the open space, recreational, or common arcas and facilities opcn <br /> to the public that the applicant proposes to reserve for thc subdivision (462.358 Subd <br /> 2,b.(d)). Sincc Lots 2 and 3 are smaller than Lot I and since Lots 2 and 3 will not have <br /> lakcshore on Lake Johanna, it is quite likely that the valuc of Lots 2 and 3 is Icss than Lot . <br /> I, which may be a basis lar reducing the park dedication fee. Furthermorc, since a large <br /> section of Lot 2 and portions of Lot 1 and 3 are included in a City stonmvater pond and <br /> wetland casemcnt, that may also warrant a reduction or elimination of the fee. Finally, <br /> the easement area can be counted as open space, which may warrant a reduction in the <br /> fee; however, the space would not be open to public usc. <br /> While the Planning Commission can provide a rccommendation to thc City Council <br /> regarding the park dedication fce, the park dedication fee is ultimately sct by the City <br /> Council. <br /> 6. The applicant shall amend thc final plat to be in <br /> confomlance with all of thc comments trom the August 281\ 2006, mcmo from the City <br /> Engineer. <br /> The City Engincer has reviewed thc Final Plat and her comments are provided in <br /> Attachmcnt 3B-2.
