<br /> 10470 <br />. 050003 <br /> 01 <br /> AGREEMENT TO CONVEY EASEMENT <br /> RIGHT OF ENTRY <br /> 1.0 PARTIES. This Agreement is dated the __ day of ___u_________. , 2006 and is <br /> entered into by and between the City of Arden Hills, a Minnesota statutory city <br /> ("City") and Arden HHls Island Beach Club, a Minnesota corporation <br /> ("Grantor") . <br /> 2.0 RECITALS. <br /> A. On the 10th day of April, 2006, the City approved plans and specifications <br /> for its 2006 Pavement Management Project ("Improvements") and <br /> authorized advertisement for bids. <br /> B. Grantor is the fee owner of real property located in the City of Arden <br /> Hills (the "Property") which is legally described as follows: <br /> That part of Lot Eleven (11) in Block Five (5) in Arden Hills, <br /> Ramsey County, Minnesota that lies southerly of the <br /> southerly line of Lot Three (3) in Block Five (5) of said <br />. subdivision as said southerly lines extend across said Lot <br /> Eleven (11) according to the plat thereof, filed of record in <br /> the Office of the Registrar of Titles within and for said <br /> county. <br /> C. In order to construct the Improvements, the City will need to acquire a <br /> permanent storm water drainage easements from Grantor over, under <br /> and across a portion of the Property. In addition, the City became <br /> aware that an additional easement is necessary to properly document <br /> the actual and required space for a sanitary sewer lift station currently <br /> located on a portion of the Property. <br /> D. Grantor has agreed to convey the above referenced easements to the <br /> City pursuant to the terms of this Agreement. <br /> 3.0 TERMS AND CONDITIONS.
