The two day exempt membrane <br /> structures would cover the f~lI11ily reunion tents, picnic tents, and similar types of <br /> tents. <br /> . Site Plan Review. Currently, to deviate from the accessory structure standards, <br /> property owners are required to through the variancc process. For the most part, it <br /> is very difficult to prove a hardship to grant a variance for an accessory structure, <br /> even if the proposal were legitimate. Another option is to have deviations from <br /> the accessory structure regulations be dealt with through the site plan review <br /> process, which does not utilize the hardship criteria but still gives the City <br /> discretion to approve or deny such applications. Under the proposal, a variance <br /> would still be rcquired to exceed the total accessory structure squarc footage <br /> pennitted for a residential property. <br /> Clear Vision Area. The existing zoning rcgulations provide two separatc definitions for <br /> the clear vision area at intersections. To be consistent, Staff is proposing to eliminate <br /> both definitions and use the clear vision area definition from the Sign Code. Sections <br /> 1325.03 Subd2.C and 1325.05 Subd 4.L have the updated definitions. The new <br /> definition does incorporate the area that would have been in the previous clear vision area <br /> definitions. <br /> At the Planning Commission work session meeting, therc wcre some suggestions made to <br />. clari fy the definition further. Attachment 3D-3 has thc revised definition. <br /> The clear vision area definition will also be added to the definitions in Section 1305. <br /> Fences (Section 1325.05 Subd 41 So far this year, the City has had two applications to <br /> construct a fence in the secondary front yard of a corner lot. Thc current City regulations <br /> prohibit fences taller than three feet in the front yard. Howcver, comer lots have two <br /> front yards and are not ablc to construct a fence in the secondary front yard without an <br /> approved site plan review. This proposal would peD11it fences up to six feet in height in <br /> the secondary front yard through the regular permitting process. Fcnccs within the cntire <br /> forty foot primary front yard setback would still be limited to three feet in height. <br /> Foundations (Section 1325.05 Subd 8). The current regulations require all parts of a <br /> principal structure to be on a continuous, solid, and peD11anent foundation. The Building <br /> Official has rcquested modifying this standard bccause it effectively prohibits the use of <br /> pier footings for three and four season porches.
