At thc recommendation of the Property <br />Maintenance Committee, the height limit for noxious wceds has been reduced from <br />twelve to eight inches. <br />1330: SHORELAND REGULA T10NS <br />At the Planning Commission work session, the proposal of banning new boat houses was <br />discussed. It was the understanding of some Staff members that new boat houses were <br />already banned. The language in the shoreland ordinance is somewhat ambiguous on this <br />issue; however, it appears that new boat houses can be pennitted through the conditional <br />use (special use) permitting process. <br />The Department of Natural Resources (DNR) was consulted, and while they do <br />encourage cities to ban new boat houses, new "water-oriented accessory structures" can <br />bc permitted by cities under ccrtain conditions. A water-oriented accessory structure is <br />most any structure that is in the required lake setback. There is a statewide prohibition on <br />ncw boathouses that are partially or entirely in the water. <br />Ifnew water-oriented accessory structures arc banned, the existing boathouses \vould . <br />become legal, nonconfonning structures that could be maintained, replaced, and rcpaired <br />as needed. However, existing boat houses could not be expanded. <br />A revised shoreland ordinance is in Attachment 30-5. <br />The definitions section from the shoreland ordinance was integrated with the definitions <br />in Section 1305. <br />SECT/ON 1335: FLOOD Pl,A1NS -- }V([S 1365 at the lvork session <br />Thcre are not any content changes to the flood plain regulations.
