<br />As part of the redevelopment proposal, the applicant is requesting three variances: <br />. Variance 1: Rear/front yard setback encroachment to construct a new dwelling with <br />an attached garage that is thirteen feet from the westem property line that is adjacent <br />to Fairview Avenue. <br />. Variance 2: Relocate and reconstruct a nonconforming accessory structure into a less <br />nonconfom1ing location; and, <br />. Variance 3: Construct a new partial gravel driveway with the reconstructed driveway <br />from Fairview Avenue. <br /> <br />While the property's address is on Lake Johanna Boulevard, the entrance to the property is <br />from Fairview Avenue on the westem side of the property. Since this property is adjacent to <br />the Lake Johanna Boulevard and Fairview Avenue rights-of-way, it is not entirely clear <br />which side of the property is the front yard and which side is the rear yard. Although a <br />variance would be required with either designation under the current redevelopment <br />proposal, the intensity of the variance changes depending on the designation. More <br />infom1ation is provided in the below sections. <br /> <br />The property has direct access to Lake Johanna, but the access is separated from the main <br />property by Lake Johanna Boulevard. No structures are proposed and no variances are being <br />requested near the lake. <br /> <br />Although the three variances are being requested together, the variances are not contingent <br />upon each other. A separate motion can be made for each variance, and there should be <br />separate findings for each variance. A motion to approve or deny any of the requested <br />variances is not a blanket approval or denial of the overall building plans. All other aspects <br />of the plans must conform to City codes and building regulations. <br /> <br />The applicant has submitted a project description letter, a letter addressing the variance <br />evaluation criteria, a site plan, and building elevations (Attachment 3D-l & 3D-3). <br /> <br />2.
