<br />topography would require fill to redevelop the property to modem standards and to meet a full 30 <br />foot setback from Fairview Avenue. <br /> <br />At the July 11, 2007, Planning Commission, there was a question regarding the width of the <br />garage and if reducing it would reduce the intensity of the variance. As noted above, the <br />applicant has moved the entire structure five feet to the east to reduce the variance request from a <br />seventeen foot encroachment to a twelve foot encroachment. The attached garage is <br />approximately 35 feet wide. Reducing one stall would likely reduce the encroachment an <br />additional ten to twelve feet, which may eliminate the need for the variance. <br /> <br />Finally, as noted the applicant letter, if the garage were detached from the principle structure, it <br />could be constructed as close as ten feet to the rear property line (Attachment 3A-l). The <br />detached garage could not exceed 728 square feet or be greater than fifteen feet in height without <br />a vanance. <br /> <br />If the Planning Commission recommends approval of the vanance, Staff recommends the <br />following six conditions: <br />1. The project shall be completed in accordance with the plans submitted as amended by <br />the conditions of approval. Any significant changes to these plans, as detennined by <br />the City Planner, shall require review and approval by the Planning Commission. <br />2. The applicant shall use best management practices (BMPs) to control erosion at all <br />times during construction. <br />3. Retaining walls greater than four feet in height shall be engineered and shall require a <br />building pernlit. <br />4. Existing retaining walls shall not be replaced and new retaining walls shall not be <br />constructed within the Lake Johanna Boulevard right-of-way without written <br />approval from Ramsey County. <br />5. The applicant shall obtain approval from the Rice Creek Watershed District prior to <br />the issuance of any building permits. <br />6. The structure shall confornl to all other regulations in the City Code. <br /> <br />Options <br /> <br />Before making a motion for approval or denial, the Planning Commission must make a final <br />finding to deternline if the plight of the landowner is due to circumstances unique to the propeI1y <br />not created by the landowner. <br /> <br />1.
