<br />boats, such as pontoons, in the water all summer, and regulating how these are stored <br />will be dealt with in the Shoreland Management Ordinance; however, once these <br />watercraft are brought on land they will fall under the purview of this ordinance, and <br />must be stored at least ten feet from the ordinary high water mark. <br /> <br /> <br />Staff Recommendation <br />Staff recommends maintaining the current code prohibiting RV storage within fifty <br />feet from the lake, and permitting water-oriented RVs to be stored as near as ten feet <br />from the ordinary high water mark, as is written in the proposed code. <br /> <br />DNR Regulations <br /> <br />8. Staff spoke with Ramsey County's water hydrologist with the DNR, and the DNR <br />does not have any specific regulations or preferences as to where boats, boatlifts, or <br />other such devises are stored when on shore. They do regulate the location of water <br />oriented structures (i.e. boathouses), but not vehicles. The DNR hydrologist did not <br />have a concern over water quality being impacted by the proximity of these vehicles <br />to the lake. <br /> <br />Variance Criteria <br /> <br />At the October 3Td Planning Commission Meeting, the Commission came 10 a <br />consensus 1hat the conditional use permit process should be removed from the <br />proposed ordinance. However, as with others parts of the Zoning Code, property <br />owners could still apply for a variance in nnique situations. <br /> <br />9. Currently, the variance process requires applicants to show that an undue hardship, <br />not created by the property owner, is present in order to gran1 the variance. This <br />criterion is set by State Statute. Based on the S1ate Statutes, it seems unlikely that a <br />variance for any RV, regardless of situation, would be possible because the property <br />owner is the one who purchased the RV, thus creating the need for the variance. <br />However, s1aff acknowledges that in creating this new RV ordinance, there will be <br />properties on which, because of the setback requirements and other regulations, the <br />storage of an RV is impossible. With this knowledge, i1 is possible to create a <br />specific set of criteria for gran1ing an RV variance that would permi1 alternative <br />locations for s10rage if issues such as lot configuration or topographic features <br />prohibited normal location regulations to be met. <br /> <br />10.
