<br />A representative from SRF will be in attendance at the meeting to help answer traffic related <br />questions. <br /> <br />5. Stormwater Requirements <br /> <br />The existing stormwater pond on the property would be retained, and the development is <br />required to meet all Rice Creek Watershed District requirements. <br /> <br />Resident Comments <br /> <br />The resident comments will be included in the full report to the City Council at the November <br />26, 2007, meeting. The comments are available upon request. <br /> <br />Planned Unit Development Review <br /> <br />Complicated development proposals rarely lend themselves to a clear answer on whether or not it <br />should be approved. Traffic impacts, parking needs, building layouts, landscaping requirements, <br />signage requests, the requested drive-through, and other impacts (positive and negative) are all <br />part of the evaluation. While a number of residents have expressed concern over a national chain <br />potentially building in Arden Hills, the City does not have the authority to deny the application <br />based on who the actual company that may occupy a building. Additionally, the City does not <br />have a legal basis to deny the application because it may add an additional pharmacy in the area. <br />Pharmacies are a permitted use in that zone. The application must be reviewed based on the <br />layout, conformance with City Codes and State Statutes, and potential impacts of the proposed <br />redevelopment, <br /> <br />Prior to making a motion to approve or deny, the Planning Commission and City Council needs <br />to make factual findings on the reason(s) for the motion. A motion without a factual basis is not <br />legally sufficient. If there is a significant negative impact that cannot be mitigated, that impact <br />should be noted for the record, If the impact can be mitigated, a condition mitigating that impact <br />should be included if it already is not. There must be a rational and publicly stated basis for <br />recommending either approval or denial. <br /> <br />Proposed Conditions <br /> <br />If the proposed redevelopment is approved, Staff is recommending the following conditions: <br /> <br />1. Conformance with Plans. The project shall be completed in accordance with the <br />submitted plans as amended by the conditions of approval. Any significant changes <br />to these plans, as determined by the City Planner, shall require review and approval <br />by the Planning Commission and City Council. <br />2. Permit Timeline.
