<br />ARDEN HILLS CITY COUNCIL - April 14, 2008 <br /> <br />21 <br /> <br />Interim City Administrator Willis stated the County has not yet responded to the City's <br />request pursuant to the City's Policy Statement. This will give the City an opportunity to start <br />talking with the County. The approval of Alternative 1 will lead to the design on the interchange <br />to TCAAP. If the City does not commit to an intersection with TCAAP, then the County will <br />provide their road design showing access to Highway 10. <br /> <br />Councilmember Holden requested an outline or schedule of what is happening with the County. <br /> <br />Mayor Harpstead stated that Civil Engineer Giga had stated that there are other steps on the <br />Position Paper that would need to be taken before the City went into preliminary design. <br /> <br />Councilmember Holden requested that County Road 96 be added to the agenda. <br /> <br />C1. Motion to Approve Publishine a Summarv of Ordinance 2008-003 <br />to Add the Interim Use Permit Process to the City Zonine Code and <br />Ordinance 2008-004 to Add Institutional Housine as an Interim Use in the B- <br />2 District as Permitted bv Minnesota State Statute 412.191. Subd. 4. <br /> <br />Councilmember McClung asked if there was anything contained in the Ordinances that was <br />time sensitive because of State law. <br /> <br />Planner I Meagan Beekman stated the City must act on this request by April 22, 2008, 60 days <br />from the receipt of the completed application, unless the City provided written reasons for an <br />additional 60 review. The project itself is time sensitive with the development. <br /> <br />It was the consensus of the Council to proceed with this item and forgo the full presentation and <br />move into questions of Staff. <br /> <br />Planner I Beekman stated that a change in the Interim Use Permit Process and the addition of <br />institutional housing as an interim use in the B-2 District had been requested by Davidson <br />Company. She stated that the State Statutes authorize interim use permits, although the City has <br />to adopt the process in order to issue an interim use permit. She also stated that an interim use <br />permit, by its very nature has an expiration date. <br /> <br />Councilmember Holden asked if the expiration date m the interim use permit would be <br />nonrenewable. <br />
