<br />ARDEN HILLS CITY COUNCIL - April 14, 2008 <br /> <br />22 <br /> <br />Planner I Beekman stated that this would be up to the City Council, in the future to decide to <br />change the ordinance, but the way this ordinance was written the Interim Use Permit would be <br />nomenewable. The Interim Use Permit would be limited to three years and the institutional use <br />would be strictly for student housing in a hotel/motel. <br /> <br />Councilmember McClung asked if the Council could later amend the non-renewal portion of <br />the ordinance. <br /> <br />Planner I Beekman stated that the City could not stop someone from requesting a zoning code <br />change; however, there is no obligation for the City Council to approve a zoning change. <br /> <br />Councilmember McClung asked if the impact of this change would adversely affect the <br />underlying nature of the zone because anything beyond retail in the zone would appear to have <br />an adverse effect. <br /> <br />Planner I Beekman stated that the use as student housing could be viewed as being compatible <br />with retail in that it is a shared market and the retail businesses could benefit from the proximity <br />of the student housing. <br /> <br />Councilmember McClung verified that the approval tonight would amend the code that <br />currently does not allow for this type of use and that three years from now the City could change <br />the code again to remove this type of use. He stated that that his concern is that anything the <br />City sees as acceptable at this time should also be acceptable three years from now. <br /> <br />Councilmember Holden asked what type of impact this would have on the study of the B-2 <br />Zone. <br /> <br />City Planner James Lehnhoff stated that this type of change would not have any impact on the <br />study itself since this is being looked as a temporary use. Recommendations from the B-2 study <br />could still be implemented and the plan could be fully implemented once this interim use was <br />completed. <br /> <br />Councilmember Holden verified that if the B-2 study stated that institutional housing should <br />not be permitted the City could change the code to not allow this type of housing and the current <br />interim housing permit would expire on its expiration date. <br /> <br />City Planner James Lehnhoff stated that is correct. <br /> <br />MOTION: Councilmember Holden moved and Councilmember Grant seconded a <br />motion to extend the meeting for an additional thirty minutes. The motion <br />carried (4- I Councilmember McClung). <br /> <br />Councilmember Holmes asked if adding the interim use only m the B-2 District IS too <br />restrictive for a code. <br />
