<br />ARDEN HILLS CITY COUNCIL - April 14, 2008 <br /> <br />23 <br /> <br />City Attorney Jerry Filla stated that the interim use permit process was permitted by State <br />Statute. <br /> <br />Councilmember Holmes clarified by stating that, by the City allowing interim uses in the <br />district is it to restrictive to allow only institutional housing in the district? <br /> <br />City Attorney Filla stated that this was permissible and that this was also a practical manner <br />because this was the only building that could be used in this manner. The City is <br />accommodating this type of transitional use because it is practical and it is for a specified period <br />of time. The Council has stated that their preference would be to have this building occupied <br />rather than be vacant. <br /> <br />MOTION: Councilmember Grant moved and Mayor Harpstead seconded a <br />motion to Approve Ordinance 2008-003 in Planning Case 08-009 to Add <br />the Interim Use Permit Process in Section 1355.04, Subd. 7, in the Arden <br />Hills Zoning Code as Proposed in the April 14, 2008, Planning Case <br />Report. The motion carried (4-1 Council member McClung). <br /> <br />MOTION: Councilmember Grant moved and Mayor Harpstead seconded a <br />motion to Approve Ordinance 2008-004 in Planning Case 08-009 to Add <br />Institutional Housing as an Interim Use in the B-2 District in Section <br />1320.085, Subd. 4 and Subd. ll, in the Arden Hills Zoning Code as <br />Proposed in the April 14, 2008, Planning Case Report. The motion carried <br />(4-1 Councilmember McClung). <br /> <br />MOTION: Councilmember Grant moved and Mayor Harpstead seconded a <br />Motion to Approve Publishing a Summary of Ordinance 2008-003 to Add <br />the Interim Use Permit Process to the City Zoning Code and Ordinance <br />2008-004 to Add Institutional Housing as an Interim Use in the B-2 <br />District as Permitted by Minnesota State Statute 412.191, Subd. 4. The <br />motion carried (4- I Councilmember McClung). <br /> <br />D. Motion to Approve Plannine Case 08-010 for an Interim Use Permit for <br />Temporary Student Housine at 1202 County Road E Based on the Findines <br />of Fact and the Submitted Plans. as Amended bv the Fourteen Conditions in <br />the April 14. 2008. Memo to the City Council. <br /> <br />Planner I Beekman stated that this motion was contingent upon the approval of the interim use <br />permit change to the zoning code. Davidson Companies is requesting this permit with the intent <br />to lease the property to Northwestern College who will then operate student housing in the B-2 <br />District at 120l County Road E. She also stated that Northwestern College would provide a <br />schedule showing their daily shuttle service. The Planning Commission recommends approval <br />with the fourteen conditions that are outlined in the Council Packet. <br /> <br />Councilmember Holden asked if Recommendation I I which describes "on-site" facilities, <br />includes the parking lot and what is the definition. <br />
