<br /> <br /> <br /> <br /> § 22-10 ARDEN HILLS CODE <br /> <br /> (c) All utilitiea be installed underground as provided in <br /> sections 28-152 through 28-161 of this Code. All under- <br /> ground work shall be completed prior to atreet surfacing. <br /> (d) Sidewalks may be required along both sides of all <br /> streets; pedestrian ways shall be paved and fenced as <br /> approved by the city council. <br /> (e) Concrete curb and gutter ahall be required. <br /> <br /> (f) Where on-site sanitary sewer facilities are proposed to <br /> be utilized, soil percolation tests shall be made with the <br /> results presented to the city engineer. The engineer shall <br /> then present a report thereon to the city council, which may <br /> prohibit the use of individual sewer systems, require larger <br /> lot sizes, or otherwise act to protect the public health and <br /> welfare. (Ord. No. 98, § 11, 3-27-67) <br /> Sec. 22-11. Building permit. <br /> , No building permit shall be issued for the construction of <br /> any building, structure or improvement on any land <br /> required to be subdivided by this chapter until all <br /> requirements of thia chapter have been fully complied with. <br /> (Ord. No. 98, § 12, 3-27-67) <br /> Sec. 22-12. Variances and egemptions. <br /> (a) Generally. The city council may grant a variance from <br /> I these regulations following a finding that all of the <br /> f following conditions exiat: <br /> f <br /> ' (1) There are special circumstances or conditions affect- <br /> , ing said property such that the strict application of <br /> ' the provisions of this chapter would deprive the <br /> applicant of the reasonable use of his land. <br /> (2) The variance ia necessary for the preservation and <br /> , enjoyment of a substantial property right of the <br /> applicant. <br /> (3) The granting of the variance will not be detrimental <br /> to the public welfare or injurious to other property in <br /> the territory in which said property is situated. <br /> 1300 <br /> <br /> <br /> <br /> L <br />
