<br /> <br /> <br /> <br /> SUBDIVISIONS § 22-12 <br /> <br /> In making this finding the council ahall consider the <br /> nature of the proposed use of land and the existing use ol' <br /> land in the vicinity, the number of persons to reside or work <br /> in the proposed subdivision and the probable effect of the <br /> proposed subdivision upon traffic conditions in the vicinity. <br /> In granting a variance as herein provided the council shall <br /> prescribe only sizch conditions that it deems desirable or <br /> necessary to the public interest. <br /> (b) Residential planned unit deuelopment. <br /> (1) Definition and exemptions. For the purpose of this <br /> chapter a"residential planned unit development" is <br /> defined to include a planned development as defined <br /> by the zoning ordinance, as amended, and shall also <br /> include, without limiting the foregoing, town house <br /> developments, apartment projects involving more than <br /> one building, and mixed commercial and residential <br /> developments which are primarily residential in <br /> character. In recognition of the probability that more <br /> attractive residential developments may be fostered by i <br /> the use of varied design techniques available with a ~ <br /> planned unit development, the following provisions of ! <br /> this section are hereby exempted for residential <br /> planned unit developments when it is proposed that <br /> the dwelling units of such developments are to be <br /> sold, but such exempted developmenta shall continue <br /> to be subject to the remaining provisions of this <br /> paragraph (b). The exempted provisions are as <br /> follows: ! <br /> a. Section 22-4. Procedure. <br /> b. Section 22-8(c)(15). Private streets. <br /> c. Section 22-8(d)(2). Pedestrian ways. <br /> d. Section 22-8(e). Easements. e. Section 22-8(f). Blocks. <br /> f. Section 22-8(g). Lots. <br /> g. Section 22-10(a)(3)d. Tree planting. <br /> h. Section 22-10(c). Utilities. <br /> i.
