Notice <br />Notice was published in the Arden Hills/Shoreview Bulletin and notice was prepared by the City <br />and mailed to residents within one thousand (1,000) feet of the subject property. <br />Northwestern College also held a community meeting on March 23, 2009, to present the project <br />to adjacent property owners. <br />Public Comments <br />Staff met with two residents that had additional questions about the building height, use of the <br />campus green, and screening of the loading dock. Northwestern College helped answer these <br />questions and conditions were added to ensure proper noise mitigation and screening techniques <br />were used to minimize impacts on nearby residential properties. Northwestern College held a <br />community meting with the neighbors to present the plans and answer questions. <br />Staff Recommendation <br />Based on the submitted plans and findings of fact, Staff recommends approval of Planning Case <br />#09-005 for a Site Plan Review and Variance for Phase II (Community Life Commons and <br />campus green) in accordance with the PUD Master Plan for Northwestern College. The <br />recommendation for approval is subject to the following sixteen conditions: <br />1. The applicant shall continue to abide by the conditions of all previous permits and <br />reviews. <br />2. The project shall be completed in accordance with the plans submitted as amended by <br />the conditions of approval. Any significant changes to these plans, as determined by <br />the City Planner, shall require review and approval by the Planning Commission and <br />City Council. <br />3. A Site Plan Agreement, drafted by the City Attorney, shall be sub j ect to City Council <br />approval and signed by the property owner prior to any work being done on the site. <br />4. The applicant shall submit a financial surety in a form acceptable to the City Attorney <br />for 125 percent of the cost of materials and installation of the landscaping plan prior <br />to the City issuing any permits. The City shall retain the financial surety for at least <br />two year after full implementation of the landscaping plan. The financial surety shall <br />only be released upon successful inspection of the landscaping by the City Planner, <br />which shall only occur during the growing season. <br />5. A temporary fence shall be placed between the construction area and the trees that are <br />to be retained on drawing L200 in Attachment E. The fence shall be subject to City <br />Planner inspection and shall be in place prior to the issuance of any building permits. <br />The fence shall be maintained and shall not be removed without City Planner <br />approval. <br />6.
