Notice Notice was published in the Arden Hills/Shoreview Bulletin and notice was prepared by the City and mailed to residents within one thousand (1,000) feet of the subject property. Northwestern College also held a community meeting on March 23, 2009, to present the project to adjacent property owners. Public Comments Staff met with two residents that had additional questions about the building height, use of the campus green, and screening of the loading dock. Northwestern College helped answer these questions and conditions were added to ensure proper noise mitigation and screening techniques were used to minimize impacts on nearby residential properties. Northwestern College held a community meting with the neighbors to present the plans and answer questions. Staff Recommendation Based on the submitted plans and findings of fact, Staff recommends approval of Planning Case #09-005 for a Site Plan Review and Variance for Phase II (Community Life Commons and campus green) in accordance with the PUD Master Plan for Northwestern College. The recommendation for approval is subject to the following sixteen conditions: 1. The applicant shall continue to abide by the conditions of all previous permits and reviews. 2. The project shall be completed in accordance with the plans submitted as amended by the conditions of approval. Any significant changes to these plans, as determined by the City Planner, shall require review and approval by the Planning Commission and City Council. 3. A Site Plan Agreement, drafted by the City Attorney, shall be sub j ect to City Council approval and signed by the property owner prior to any work being done on the site. 4. The applicant shall submit a financial surety in a form acceptable to the City Attorney for 125 percent of the cost of materials and installation of the landscaping plan prior to the City issuing any permits. The City shall retain the financial surety for at least two year after full implementation of the landscaping plan. The financial surety shall only be released upon successful inspection of the landscaping by the City Planner, which shall only occur during the growing season. 5. A temporary fence shall be placed between the construction area and the trees that are to be retained on drawing L200 in Attachment E. The fence shall be subject to City Planner inspection and shall be in place prior to the issuance of any building permits. The fence shall be maintained and shall not be removed without City Planner approval. 6.
