Approve Resolution 2008-052 for the Vacation of Various <br />Easements and a Public Ri!!ht-of-Way as part of the Final Plat for <br />the Traverse Business Center and Rescind Resolution 2008-016, as <br />proposed in the November 10, 2008, Report to the City Council <br /> <br />City Planner Meagan Beekman stated On October 29, 2007, the City of Mden <br />Hills approved a planned unit development (PUD) permit to CMK Mden Holdings <br />(Chesapeake Companies) for the Traverse Business Center. 1\s part of the proposal <br />to replat the property, the applicant requested that the City vacate several easements <br />and the right-of-way for 13th Street ~E, which only serves the applicant's property. <br />On July 14,2008, the City of Mden Hills approved resolution 2008-016, vacating <br />the requested easements and the right-of-way. The resolution was then filed with <br />Ramsey County by the applicant. In the process of reviewing the vacations in order <br />to assign document numbers to them, the County discovered that the legal <br />descriptions for one of the easements and the right-of-way that was vacated <br />included descriptions of areas to the north and not located on the Traverse Business <br />Center Plat. This discrepancy was brought to the attention of the City Staff and the <br />City i\ttorney. Since it was clearly not the intent of the City to vacate areas not <br />encompassed by the Traverse Business Center Plat, the City 1\ttorney drafted a new <br />resolution that rescinds the previous vacation, Resolution 2008-016, and corrects <br />the descriptions of the areas to be vacated; limiting them only to those areas within <br />the designated plat. Staff recommends approving the vacation of the five easements <br />and the right-of-way and rescinding Resolution 2008-016. <br /> <br />Mayor Harpstead opened the public hearing at 7: 10 p.m. <br /> <br />Mayor Harpstead closed the public hearing at 7:11 p.m. <br /> <br />MOTION: Councilmember Grant moved and Councilmember Holden <br />seconded a motion to 1\pprove Resolution 2008-052 for the Vacation <br />of Various Easements and a Public Right-of-Way as part of the Final <br />Plat for the Traverse Business Center and Rescind Resolution 2008- <br />016, as Proposed in the ~ovember 10, 2008, Report to the City <br />Council. The motion carried unanimously (5-0). <br />
