Council Questions and Concerns <br />Below is a list of questions and concerns raised by the Council at the September 28, <br />meeting in regards to the proposed changes to the City's liquor regulations, and Staff s <br />response to each. <br />L Can an establishment have both a liquor license and an adult use license? <br />Language has been added to the Code that would prohibit an establishment that <br />has an adult use license from obtaining a liquor license from the City. <br />2. Does an intoxicating liquor license include the sale of wine and 3.2 percent malt <br />liquor as well, or are separate licenses required? <br />According to State Statute, an intoxicating liquor license includes the sale of <br />wine, but not of beverages that contain less than 3.2 percent alcohol by weight, <br />such as 3.2 percent malt liquor. A separate license would be required to sell both. <br />3. How do the proposed changes impact gambling in an establishment? <br />State law bans gambling in all establishments that hold a liquor license. <br />Gambling is defined separately from "lawful gambling". Lawful gambling <br />includes pull tabs, pinwheels, raffles, and bingo. This means that establishments <br />that have a liquor license from the City can also obtain a license from the State to <br />have lawful gambling activities as well. The City can determine what type of <br />establishments can have a liquor license, but lawful gambling licenses are issued <br />by the State. Charitable gambling is defined differently and is gambling that is <br />permitted for non-profit organizations, such as raffles for church events. <br />4. What are the details for regulating an optional server training program? <br />Using a tiered administrative fine system for violations of the minor consumption <br />law is a common way for cities to promote optional server training programs. <br />There are many organizations that offer such training. The City of Roseville has a <br />list of programs that have been approved by their police department. In addition <br />the City of Roseville's police department offers their own training materials that <br />can be used by an establishment as they train in each new employee (attachment <br />Q. A survey of six different for profit training programs revealed a cost of <br />approximately $20 per person being trained. The City of Roseville does not <br />charge anything for their training program. The Minnesota Licensed Beverage <br />Association also offers training programs for their members. <br />5.
