Recommendation <br />Upon review of the proposal, staff is recommending approval of all seven requests based on the <br />findings of fact subject to the following fifteen conditions: <br />1. The project shall be completed in accordance with the submitted plans as amended by <br />the conditions of approval. Any significant changes to these plans, as determined by <br />the City Planner, shall require review and approval by the Planning Commission and <br />City Council. <br />2. Executing the Final Plat and publishing the rezoning shall be contingent upon the <br />Metropolitan Council's approval of the Comprehensive Plan Amendment. <br />3. A development agreement shall be prepared by the City Attorney and subject to City <br />Council approval. The development agreement shall be executed prior to execution <br />of the Final Plat, the issuance of any permits, or site preparation. <br />4. The applicant shall file the Final Plat with Ramsey County within 180 days of the <br />approval from the City. <br />5. The applicant shall obtain a building permit within one year of the Final PUD <br />approval or the approval shall expire unless extended by the City Council prior to the <br />approval's expiration date. Extension requests must be submitted in writing to the <br />City at least 45 days prior to the expiration date. <br />6. The applicant shall submit a financial surety in the amount of 125 percent of the cost <br />of the landscaping improvements prior to the issuance of any building permits. <br />7. The applicant shall obtain approval from the Rice Creek Watershed District and all <br />other applicable permitting agencies prior to the issuance of any permits. Copies of <br />such permits shall be provided to the City prior to the issuance of any permits. <br />8. The plans shall be subject to Fire Marshal approval before building permits are <br />issued. <br />9. Final grading, drainage, and utility plans shall be subject to approval by the Public <br />Works Director and City Engineer prior to the issuance of any building permits. <br />10. The existing tower shall be brought into compliance with Conditional Use Permit 72- <br />24 or an amended CUP prior to executing the Final Plat and the issuance of any <br />building permits. <br />11. An updated structural analysis report shall be conducted on the tower and submitted <br />to the City prior to the issuance of any building permits to confirm compliance with <br />the Conditional Use Permit and City regulations. <br />12. The applicant shall construct approximately 1,680 feet of trail along the south side of <br />County Road F, subject to the approval of the City Engineer and Ramsey County, <br />which will connect their property with Lexington Avenue. <br />13. The applicant shall provide the required number of ADA parking spaces. The ADA <br />parking space locations shall be subject to Building Official approval. <br />14.
