ARDEN HILLS CITY COUNCIL-July 13, 2009 31 <br /> Mr. Nielson stated that there are trees surrounding the tower that help shield its <br /> appearance from the neighboring community. <br /> Councilmember Grant stated that the buildings are located relatively close to the <br /> tower so it should not need to be this tall. <br /> Mr. Nielson stated that the engineers had determined that 75 feet would be <br /> necessary. <br /> Councilmember Grant stated that recommendation 5 states there would be <br /> vegetative screening from adjacent properties. He stated that this would not be a <br /> reality if the tower was 75 feet tall. He stated that he would not be able to support <br /> this amendment. <br /> MOTION: Councilmember Grant moved and Councilmember Holden <br /> seconded a motion to Not Approve Planning Case 09-009 for a <br /> Conditional Use Permit Amendment at 3900 Bethel Drive Based on <br /> the Findings of Fact and the Submitted Plans as Amended by the Five <br /> Conditions in the July 13, 2009, Memo to the City Council. <br /> City Planner Beekman stated that the findings of fact would need to be amended <br /> to support the motion for denial. <br /> Councilmember Grant stated that the reason for the denial would be visual - <br /> impact. - <br /> City Planner Beekman stated that the motion would not include the findings of <br /> fact. <br /> City Planner Beekman clarified that the motion would be to deny Planning Case <br /> 09-009 for a Conditional Use Permit Amendment at 3900 Bethel Drive based on the <br /> visual impacts on the surrounding City and the inability to effectively screen the <br /> structure to accommodate for these impacts. <br /> Mr. Nielson stated that this concept was their best attempt at meeting the City's <br /> code. <br /> Councilmember Holmes stated that she would not support the motion on the table <br /> because she was in favor of the tower and providing this service to Bethel <br /> University, its students and its faculty. <br />
