ARDEN DILLS CITY COUNCIL—JUNL 14, 2010 5 <br /> 7B. Resolution 2010-033 — Declaring Cost to be Assessed and Ordering Preparation of <br /> Proposed Assessment Roll for the 2010 PMP (continued) <br /> Councilmember McClung stated the property in the mill and overlay neighborhood should pay <br /> the assessment on the vacant lot within the mill and overlay district. However, the two properties <br /> within the reconstruct district should follow Option D with a record agreement against the <br /> property requiring that the subdivision could not approved unless the second assessment were <br /> paid. <br /> Councilmember Holden agreed with Option D. <br /> Councilmember Grant favored Option D as well, and did want to see the vacant lot within the <br /> mill and overlay district assessed. <br /> Mayor Harpstead stated he was in agreement with the Council to move forward with Option D <br /> and to assess the vacant lot as it was buildable. <br /> Councilmember Grant questioned if the recording against the properties was placed on the deed. <br /> City Attorney Filla stated the agreement would have a legal description recorded against the <br /> property. <br /> MOTION: Councilmember McClung moved and Councilmember Holden seconded a <br /> motion to approve Resolution 2010-033: Declaring cost to be assessed and <br /> ordering preparation of proposed assessment roll for the 2010 Pavement <br /> Manazement Program. The motion carried unanimously (4-0). <br /> C. Planning Case 10-008 — An Amendment to the Arden Plaza Master PUD and <br /> Final PUD for Phase I <br /> City Planner Meagan Beekman stated the applicant is requesting an amendment to the Master <br /> Planned Unit Development and Final PUD for Phase 1 of the Arden Plaza Redevelopment <br /> Proposal at 3527 Lexington Avenue that would allow an alternative development option. She <br /> reviewed the redevelopment application that was first approved in June of 2009 for the Arden <br /> Plaza retail center. Given the delays of the project due to unforeseen market conditions and <br /> extended negotiations with Walgreens, the applicants are requesting a one year extension for filing <br /> the Final Plat with the County and for submitting for building permits for each of the three phases. <br /> Building 3 was now being suggested to be an open green space which would increase the <br /> landscape coverage of the overall PUD. The applicant has revised the elevations of Phase I and <br /> the Planning Commission did recommend approval of these changes. Staff recommended <br /> approval of the amendment to the Master PUD and Final PUD for Phase I of the Arden Plaza <br /> Redevelopment Proposal along with an amendment to the Arden Plaza Development Agreement, <br /> based on the Findings of Fact and the submitted plans. <br /> Councilmember Holden questioned how Building 3 could be added in the future if Walgreens <br /> owned the building and site. <br />
