applicant shall abide by all conditions listed in the October 28, 2010, Public Works <br />Department memo. <br />6. The applicant shall obtain approval from the Rice Creek Watershed District and all <br />other applicable permitting agencies prior to the issuance of any permits. Copies of <br />such permits shall be provided to the City prior to the issuance of any permits. <br />7. The applicant shall submit a financial surety, in a form subject to the approval of the <br />City Attorney, in the amount of 125 percent of the cost of the landscaping <br />improvements prior to the issuance of any building permits. The financial surety <br />shall be held by the City for two years from the completion of the landscaping plan <br />and shall be released in accordance with the City's regulations. <br />8. The applicant shall provide a construction phasing plan that includes plans for fire <br />and police access throughout construction, subject to the approval of the Fire <br />Marshall, Public Works Director, and Ramsey County Sheriff prior to the issuance of <br />any building permits. <br />9. The applicant shall obtain a building permit within one year of the Master and Final <br />PUD approval or the approval shall expire unless extended by the City Council prior <br />to the approval's expiration date. Extension requests must be submitted in writing to <br />the City at least 45 days prior to the expiration date. <br />10. The applicant shall work with adjacent property owners along Shorewood Drive and <br />County Road D to determine exact location and species of landscaping materials to be <br />planted along the east property line. <br />11. It is the policy of Presbyterian Homes to allow public use of the trail systems which <br />are developed on its properties so long as the public does not abuse the privilege or <br />create an adverse affect on the property. The policy of Presbyterian Homes will be <br />applied to the trail system shown on the site plan. Presbyterian Homes will notify <br />the City thirty (30) days in advance of a change to its policy and of the reasons for the <br />change. <br />12. Garbage and recycling containers shall be fully screened from view of residential <br />properties and shall be located in the lower level of the loading and service area <br />designated on the rendered site plan. <br />13. If a warrant analysis indicates that a four -way or a three -way stop is necessary at the <br />intersection of the entrance to the Property on County Road D and Wheeler Avenue, <br />Developer, at its sole expense, shall construct such four -way or three -way stop <br />according to plans and specifications approved by the City Engineers for the City of <br />Roseville and the City of Arden Hills. <br />14. Traffic leaving the site onto County Road D shall be prohibited from continuing <br />directly down Wheeler Avenue with a right out only barrier curb median, subject to <br />the approval of the Public Works Director. <br />Requested Action <br />1.
