<br /> <br />CITY OF CENTERVILLE <br />PLANNING & ZONING COMMISSION <br />FINDINGS & CONCLUSIONS <br /> <br />Whereas, the Planning and Zoning Commission is tasked to fulfill the goals of the <br />Centerville Comprehensive Plan. <br />Whereas, that Comprehensive Plan guided certain industrial zoned areas to be <br />repurposed for commercial uses. (Hereinafter, “repurposed area.”) <br />Whereas, prior to the formation of that Comprehensive Plan, the City created a <br />tax increment financing district (hereinafter, “TIF district”) which successfully attracted <br />businesses to locate in the repurposed area. <br />Whereas, the existing and conforming businesses in the repurposed area <br />(hereinafter, “businesses”) desire to build upon their investments and goodwill. <br />Whereas, on March 1 2011, the Commission held a public hearing to discuss <br />changes to the repurposed area and Chapter 156.030 of the Centerville Code. As a result <br />of that hearing the Commission makes the following findings of fact. <br /> <br />Rezoning the repurposed area from industrial use (I-1) to commercial use (B-1) is <br />in keeping with the guidance set forth in the Comprehensive Plan. <br />The City can recover the maximum benefit from the TIF district in the repurposed <br />area by maintaining high property values and retaining viable businesses. In order to do <br />so these businesses must remain and flourish in the repurposed area. <br />Businesses are likely to remain and flourish in the repurposed area if they can <br />continue their current industrial uses, and maximize their investments and goodwill. This <br />includes creating opportunities for these businesses to expand and grow in the future. <br />Allowing these businesses to continue in the new commercial zone with interim <br />industrial uses balances the need for business opportunities and investment growth while <br />allowing for future conversion of the repurposed area from industrial to commercial uses. <br /> <br />Based on these findings, the Commission concludes and proposed the attached <br />amendments to Chapter 156.030 of the Centerville Code. The Commission recommends <br />that the City Council adopt these findings and amendments to Chapter 156.030. <br /> <br />PROPOSED AMENDMENTS: <br /> <br />156.030 Commercial District (B-1) <br /> <br /> (N) Interim uses in B-1 District. <br /> <br /> (1) Uses existing on a site in the I-1 Industrial District as a <br />conforming use prior to the site being rezoned from I-1 to B-1 may <br />continue to be used for such conforming I-1 uses, regardless of site <br />ownership. In addition, the activities and operations may be expanded <br />on the site as if the use was located in an I-1 District, until such time <br />the use is abandoned or changed to a use permitted in the B-1 District. <br />After the use of the site is abandoned or is changed to a permitted use <br /> <br /> <br />
