Planning and Zoning Commission
July 2, 2002
Meeting Minutes

Mr. Rosenthal indicated he had met with most of the neighbors and had not had any
negative feedback.

Ms. Moore-Sykes indicated that Mr. Rosenthal would need to submit a grading plan
because he would not be allowed to alter the grade in any fashion that would impede
upon his neighbors.

Commissioner Helmbrecht asked if there was a buffer between residents and the existing
building.

Mr. Rosenthal indicated there are large willow trees planted when the building was
constructed 20 years ago that act as a nice buffer. He then indicated he intends to either
use fencing or landscaping to buffer the new building.

Commissioner DeVine indicated that any building over 5000 square feet would require a
sprinkler system. He then asked whether the existing building used well water and noted
that, if the building is required to have sprinklers, City water would need to be added to
the project.

Mr. Rosenthal indicated that the existing building does use the well but indicated he
would be adding City water. He then indicated that, at some point in the future, a cul-de-
sac should be added to allow for two lots to be developed.

Mr. Rosenthal asked if it is hard to obtain a special use permit because the businesses he
intends to solicit for tenants would need special use permits.

The Commission recommended meeting with City Staff to discuss the special permit
process.

Commissioner Wilharber asked how Mr. Rosenthal intended to continue the sewer line.

Mr. Rosenthal indicated that Roso Construction had offered to let him tap into the
existing line.

Mr. Rosenthal indicated he would like to update both buildings and then commented he
had gone through an eminent domain proceeding in St. Paul and has three years to
reinvest the money in order to avoid paying taxes.

Ms. Moore-Sykes recommended that Mr. Rosenthal discuss his intentions concerning the
sewer line with Mr. Palzer as he would know the required regulations.

Council Member Travis indicated Mr. Rosenthal would not be able to hook into the
sewer line without a public utility easement.
