Memorandum: Dave Nyberg
April 3, 1998
Page Two
2. This is essentially the same as discussed at the workshop except for the statement that legal,
administrative and preliminary engineering costs are to be paid separately by each City.
"Construction costs shall be divided proportionately, 50% to Lino Lakes and 50% to
Centerville, for Phase I and all future phases. Overhead costs shall be determined by
negotiation prior to preparation of plans and specifications."
5. Most of this section is phrased as it was at the workshop. The exception is a condition that
"payment of the statement shall be completed within 45 days upon receipt of the statement. "
" le The non - administering city shall pay to Lineiales the initiating,
administering city monthly, as certain portions of the construction are completed, the Project
amounts then due and payable for work completed. Upon completion of the entire Project,
Centerville will make the final payment after receiving the final cost statements from Lino
Lakes for the completed Project. Reimbursement for overhead costs shall be made when
each phase of the project is complete and final."
6. The March 24" Agreement is stated the same as it was at the workshop. There was, however,
some discussion that more protection would be afforded the City with a provision that right -of-
way should be obtained prior to Council Action approving a feasibility study, or an equivalent
opportunity be available for privately installed improvements.
9. This is essentially the same as discussed in the workshop except for editorial changes.
"Sanitary sewer and watermain services may be extended to serve property within the City of
Centerville upon Centerville's request. Fees for connection to such services will be subject to
the policies outlined in the City of Lino Lakes policy resolution number _ and the
City of Centerville policy resolution number »
PB: tw
Howard R.
