Councilmember Helmbrecht stressed the Developer is required to disclose an exhibit at closing, <br /> stating where "trailway easements" are located on a property. Councilmember Powers welcomed <br /> comments on the City's recourse to the Developer since this appears to be in conflict with the <br /> Development Agreement. <br /> MOTION by Councilmember Helmbrecht to request Rockne Goertz (K -G Development) to <br /> provide the City with supporting documentation that the property owners were informed about <br /> the trailway easement at or prior to closing and the Staffsi to furnish the City's legal recourse, <br /> based on the Development Agreement. Motion seconded by Councilmember Powers. Motion <br /> carried unanimously. <br /> Sod Policy <br /> Mr. Coffman concluded the City's Sod Policy was not disclosed at their closing, therefore, they <br /> spent approximately $400 on black dirt and seed for their front yard. <br /> Councilmember Helmbrecht reiterated the City's Sod Policy which is to be disclosed to the <br /> property owner at closing as stated in the Development Agreement. Mr. Coffman requested the <br /> Council allow the seeded lawn remain. Councilmember Helmbrecht explained the Council can not <br /> deviate from the City Ordinance. Mr. Nyberg reported the Lakeland Hills Development <br /> Agreement requires a signed Sod and Easement disclosure be presented, to the City, prior to the <br /> issuance of a building permit. Councilmember Helmbrecht suggested using the developers escrow <br /> to sod the Coffman family front yard. <br /> Community Mail Box <br /> Mr. Hanggi explained several residents on Brian Drive purchased and installed mail boxes without <br /> knowledge of the City installed mail box policy. Further requesting the Council allow this <br /> neighborhood to install and maintain independent mail boxes. Mr. March spoke with the Post <br /> Master and reported there is no options on individual mail boxes they must be community mail <br /> boxes. <br /> Ken Sorenson - Benefit for Flood Relief - Tabled <br /> UNFINISHED BUSINESS <br /> Lakeland Hills Development Contract <br /> Mr. Nyberg distributed a letter dated July 9, 1997. Mr. Nyberg referred to the letter, suggesting <br /> the Lakeland Hills Development Contract be approved contingent upon future administrative <br /> approval. Mr. March reported the restrictive covenant will be disclosed to property owners with <br /> easement and sod exhibits. Council made adjustments to the Development Contract. <br /> Mr. Mike Black (Royal Oaks Realty) suggested an adjustment requiring Royal Oaks provide <br /> signed copies of exhibit A and B prior to the issuance of a building permit. <br /> 3 <br />
