Council Meeting November 13, 1996 <br /> MOTION by Brenner, seconded by Helmbrecht to approve the delinquent water bill <br /> resolution for the delinquent water bills to be certified to the county auditor, under code <br /> 825.98. Motion carried unanimously. <br /> MOTION by Brenner, seconded by Buckbee to approve the delinquent garbage resolution <br /> with the deletion of Joseph Salhstrom. Motion carried unanimously. <br /> ASSESSMEN1 HEARING FOR CLEARWATER MEADOWS AND BRIAN <br /> DRIVE WATERMAIN SERVICES, <br /> Helmbrecht opened the Public Hearing on Clearwater Meadows and Brian Drive <br /> Assessments. Nyberg explained the procedures. Nyberg indicated the proposed <br /> assessment at $1,644.91 for a period of 10 years with an interest rate of 8% annual <br /> compounding, the first payment of $270.38 the remaining payments of $245.14. <br /> Kevin Fogerty of 7088 Brian Drive questioned the conclusion of the assessment amount, <br /> suggesting the council consider lowering the S.A.C. fees. <br /> Steven Yoch - representing Rockey Goertz of Klosner Goertz Homes Inc., questioned <br /> the council if they received Mr. Goertz objection letter. March acknowledged receipt of <br /> the letter. Yoch continued explaining the City Hall Watermain improperly charges K -G <br /> for the entire cost of the City Hall watermain when other property owners will benefit <br /> from the improvement. The assessment should be adjusted to reflect the proportional <br /> benefit which will be realized by others. In particular, the Eagle Pass subdivision will <br /> contain over 140 units which will benefit from this improvement and are not being <br /> assessed. <br /> Yoch further explained the period of the assessment; the proposed assessment requires <br /> payment over five years while the Development Contract Clearwater Meadows (June 10, <br /> 1996) between the City and K -G requires payment over ten years. <br /> Nyberg questioned Mr. Goertz's request for the terms 6.5% over 5 years then asked if that <br /> was the terms the City and Mr. Goertz agreed upon. <br /> Nyberg asked Mr. Goertz if the interest rate of 6.5% with 5 year payments were the terms <br /> the City and Mr. Goertz agreed with. Mr. Goertz simply would like to see a break down <br /> on all fees, administration, engineering and construction since he is paying for each. Yoch <br /> suggested sitting down with Mr. Nyberg to discuss the fees and the assessment amounts <br /> prior to the council adopting the assessment. Further, the terms in the developers <br /> agreement were 8% over 10 years. Yoch stated if the City adopts the assessments tonight <br /> then they will go to court. March asked if Carolyn Drude recalled a meeting with Mr. <br /> Goertz and himself when the term length of the bonds were discussed. Ms. Drude recalled <br /> the meeting and recalled the terms 6.5% interest with maturity in the fifth year. Mr. <br /> Goertz commented its not that the term issue isn't the end of the world, he would just like <br /> 2 <br />
