<br />Mayor Sweeney opened the public hearing. <br /> <br />Council ~ember Capra suggested adding language to include musical bands and base or <br />beat because that seems to be the biggest issue in the downtown area. <br /> <br />Council Member Paar indicated he received a call on noise concerning base because it <br />does not have to be loud enough to be an ordinance violation to be annoying. <br /> <br />Council Member Broussard Vickers indicated that the ordinance allows officers the <br />ability to ticket someone for violating the ordinance even though the noise is not on the <br />noise chart if the officer feels it is a nuisance. <br /> <br />Council Member Lee indicated he would have an issue if it is the same people calling the <br />police week after week. <br /> <br />Council Member ~apra commented that it is not every time and there are some nights <br />that there are bands at Kelly's and it does not bother the residents. <br /> <br />Mayor Sweeney indicated he talked to a resident that lives near Kelly's and he was there <br />two weeks ago and thought the band was loud inside the building but there were no noise <br />complaints so the noise must not have carried outside the building. <br /> <br />Council discussed the times and agreed to have summer and winter hours coinciding with <br />daylight savings time. Summer hours go to 10:00 p.m. and winter hours are 9:00 p.m. <br /> <br />Motion bv Council Member Broussard Vickers. second bv Council Member Paar to <br />close the public heam!!. All in favor. Motion carriedunanimouslv. <br /> <br />Mayor Sweeney closed the public hearing at 7:54 p.m. <br /> <br />VII. NEW BUSINESS <br /> <br />1. Sedona Homes Developer's Agreement/Final Plat <br /> <br />City Attorney Hoeft reviewed the outstanding issues he has as listed in the Clerk's memo <br />provided to Council with today's date. <br /> <br />City Attorney Hoeft indicated that there was a name change from Sedona Homes to <br />Jackson Commercial, L.L.c. and he would need clarification as to who Jackson <br />Commercial, L.L.C. is and what type of position they are in to undertake this type of <br />development. <br /> <br />City Attorney Hoeft indicated that he would need to see the purchase agreement showing <br />that they are under contract to purchase the property pending City approvals to ensure <br />they have the authority to enter into the agreement. <br /> <br />Page 4 of 14 <br />
