<br />City Attorney Hoeft indicated that he and Ms. Moore-Sykes met with the St. Paul <br />Waterworks representatives and there is a proposal under consideration to sell the <br />property back to adjoining property owners along the lake so there is potential that the <br />City may be asked if it wants to purchase that property along the lake if the City owns <br />this piece of park land. <br /> <br />Council Member Paar asked what happens when houses go up and someone's child <br />drowns on the park property. <br /> <br />City Attorney Hoeft indicated the City could be liable but there are a lot of variables. He <br />then recommended that the City discuss the matter with its insurance representative to see <br />if they have any concerns. <br /> <br />Council Member Broussard Vickers indicated that even if St. Paul Waterworks sells the <br />property back she is not sure that the City has money to look at buying the property. <br /> <br />Council Member Capra indicated those that live behind it may be interested in purchasing <br />it and it is just a small section that the kids fish on. <br /> <br />Mr. Gonyea indicated he had no issue either with deeding the property to the City as an <br />outlot or providing an easement. <br /> <br />Council Member Capra indicated that the residents wanted park property and this was a <br />way of giving them an area where the kids can go and fish. <br /> <br />Council Member Lee indicated he would like to have the property deeded to the City. <br /> <br />Council Member Broussard Vickers asked how many were in favor of the park property <br />being owned by the City. <br /> <br />Council Member Broussard Vickers asked who owns this land and if the owner is <br />required to let anybody come on the park easement portion. <br /> <br />City Attorney Hoeft suggested calling it a park and drainage easement because that way <br />the City could use it for park purposes. <br /> <br />Council Member Broussard Vickers asked what liability the landowner would have. City <br />Attorney Hoeft indicated the City would incur the liability not the landowner. <br /> <br />Mr. Gonyea indicated that the City would be responsible for maintaining the property so <br />the City may as well own it. <br /> <br />Council Member Broussard Vickers indicated that she does not want to own it and she <br />does not want to have a park easement on it. <br /> <br />Page 16 of24 <br />
