Sent: <br />To: <br />Cc: <br /> <br />By now you should have seen the letter and attachments of our issues which I handcarried <br />to the city Friday afternoon, with individual copies to the mayor and council, city <br />attorney, city engineer, city public works, etc. We look forward to a formal response to <br />our letter, and scheduling of further discussion and action by the council at its' July 23 <br />meeting (per direction of the Mayor at the council meeting on July~th. While all the <br />issues presented are important to us, two require immediate attentidn by the city: (1) a <br />city engineer and public works inspection and review of the pre-sod grading and drainage <br />of the new Portage Way addition to insure that there won't be future problems with <br />drainage there (these are provided for in the development contract and can be billed to <br />the developer); and (2) immediate enforcement of the silt fencing and sweeping of affected <br />streets by the developer in accordance with terms of the Development Contract for the 2d <br />Addition (Portage Way) to Eagle Pass. We've communicated this several times before to the <br />city and nothing has been done. Silt and sediment are still flowing into the storm celler <br />and into the pond and Rice Creek Watershed. If the developer won't do it, then the city <br />should arrange <br />for it and withhold money from the development contract escrow. <br />It is amazing to me that, with all of our communication of these issues, we (our <br />association) get an email from the city clerk on July 1, 2003, stating that the city has <br />received a complaint from a single family home abutting our development regarding the <br />cutting of weeds behind 7031 Eagle Trail, and quoting city ordinance #54 on the <br />requirement to control weeds, and that the city would appreciate our prompt cutting of <br />this area. We responded at once and did what the city requested (we had been holding back <br />on this area pending resolution of the drainage problem along this area) but did what the <br />city told us to do anyway.
