<br />I <br />, I <br /> <br />City of Centerville <br />July 9, 2003 <br />Council Meeting Minutes <br /> <br />Council Member Broussard Vickers indicated that the Planning Commission discussed <br />the numbers at length but did not discuss eliminating maximum size but did make a <br />change to allow either residential use or commercial use requirements depending on how <br />the mixed use property is being used. <br /> <br />City Attorney Hoeft indicated that this discussion was out of procedure because Mr. <br />Kilian applied for a variance in 1999 an~ whether or not that was grant~ denied or in <br />limbo is in question but he did not build the garage and in 2000 the Ordinance was <br />changed so he needs to fill out a variance application and come before Planning and <br />Zoning on that application. He then said that, if Council feels it is appropriate and Staff <br />can verify that the variance fee was paid the first time, the fee could be waived for the <br />new application. <br /> <br />Mr. Kilian indicated he had gone before the Planning. Commission and the Commission <br />made a motion to recommend to Council that he be allowed to build his garage and it <br />passed unanimously. <br /> <br />Council Member Capra indicated that the variance application from 1999 was not signed <br />or dated. <br /> <br />Mr. Kilian indicated he applied and was told that Ordinance #4 was going to be amended <br />and that he needed to wait. <br /> <br />Council discussed the garage and the commercial versus residential requirements and <br />determined that Mr. Kilian would either need to meet the requirements of the Ordinance <br />or apply for a variance. <br /> <br />Council Member Broussard Vickers indicated that, based on the minutes from 1999, Mr. <br />Kilian was granted a variance for a porch and not the garage. <br /> <br />Council Member Capra indicated that the City Clerk was not able to find information on <br />whether or not the fee for the variance was paid in 1999. <br /> <br />Council Member Broussard Vickers indicated that Mr. Kilian knows the requirements for <br />approval of a variance and indicated that she does not see how the situation meets those. <br />She then cautioned him to consider that before applying for the variance because the fee <br />is required whether or not the variance is approved. <br /> <br />Mr. Kilian commented that, if he were to attach the garage, he could build a 1,500 square <br />foot garage. <br /> <br />Council indicated that Mr. Kilian was free to construct his garage in any manner that <br />meets the Ordinance requirements. <br /> <br />Council Member Broussard Vickers indicated that the size of the attached garage could <br />not exceed the size of the principal structure. <br /> <br />Page 4 of 10 <br />
