Requests to Remain Open and Serve Liauor until 2:00 am. Trio Inn Kellv's <br />Komer. Waterworks Beach Club <br /> <br />City Attorney Hoeft indicated that the City's Ordinance indicates that the City will follow <br />the state statute guidelines for the hours of operation of liquor establishments. He then <br />indicated that if the City did not want its liquor license holders to stay open until 2:00 <br />am. then the Ordinance would need to be amended. Otherwise, a motion to uphold the <br />current variance requirements would suffice to allow them to serve until 2:00 am. <br /> <br />Council Member Capra commented that Chief Heckmann had expressed a concern about <br />the time involved in processing a Dill case and asked whether the City wished to <br />increase the fees for the later closing time. <br /> <br />Council Member Broussard Vickers indicated that she did not see how staying open one <br />hour later was going to increase traffic violations. She then commented that it pushes the <br />violations back one hour but should not increase them. <br /> <br />Motion bv Council Member Broussard Vickers~ seconded by Council Member Paar <br />to abide by the current Ordinance reauirements that references state statute. All in <br />favor. Motion carried unanimously. <br /> <br />4. Eagle Pass Issues/Concerns <br /> <br />Ms. Moore-Sykes indicated she had received an email forwarded to her by Council <br />Member Paar from Mr. Halstrom concerning issues with Eagle Pass. <br /> <br />Council Member Capra indicated that she had received a call from Mr. Nohner, 1855 <br />Pioneer Lane concerning drainage issues in Eagle Pass. <br /> <br />Council discussed the drainage issue and asked Staff to determine whether the pin for the <br />property line location can be located to determine whether the timbers and fill are located <br />in the easement area or not. And, if so, direct a letter to the property owner asking that <br />the items be removed from the easement area or the City will do so. <br /> <br />Mr. Nohlner indicated that the drainage has been an ongoing issue but he is more <br />concerned with the fact that City Staff has not responded to his numerous requests for <br />assistance and information concerning the grading and whether or not it was done to the <br />required specification. He then said that if Swift is responsible then the City and the <br />homeowners should not have to pay to solve the problem. <br /> <br />Mr. Peterson indicated that the City had looked into the matter and the grade is at 1 % as <br />required. <br /> <br />Council Member Capra indicated that the determination was made in Mayor June and <br />that it is a 1 % grade.
