<br />2. Mr. Richard S. Carlson, Hunter's Crossing 2nd Addition Rezone, Lot Combination <br />& Preliminary Plat <br /> <br />Mayor Sweeney opened the public hearing at 7: 15 p.m. <br /> <br />Mr. Carlson addressed Council and provided an overview of Phase I of Hunter's Crossing <br />2nd Addition. <br /> <br />Mr. Carlson indicated that Mr. Wilharber has asked that the feasibility study include his <br />two properties and he is asking that the property to the south be included making the <br />development 36 lots. <br /> <br />Council Member Capra asked how the development would meet the 20% green space <br />requirement. <br /> <br />Mr. Carlson indicated that there is 43 acres of land and over 10 acres is in ponds and <br />there is extra square footage per lot beyond the requirements. He then said that he feels <br />the development is at 25% green space. <br /> <br />City Attorney Hoeft indicated that green space is more accurately referred to as open <br />space. <br /> <br />Mr. Carlson indicated the wetlands shown are protected and will be fenced off with <br />erosion control methods and will be restricted as to mowing and dumping. <br /> <br />Mr. Carlson indicated the permits were applied for with Rice Creek Watershed District. <br />He then indicated that the Planning Commission had revised the requests of the Park <br />Committee with regard to the trail and park land. He further commented that the pond <br />was eliminated to limit liability to the City as well as the trail around Mr. Wilharber's <br />property. The trail would connect to the Lino Lakes trail. <br /> <br />Mayor Sweeney indicated he would like to see a sidewalk on Dupre Road. He also <br />indicated he would like to see Shotgun Trail renamed to Dupre Road. <br /> <br />Mr. Wilharber indicated that the City would have liability for anyone being injured on or <br />in the pond as well as increased costs of maintenance for a trail around the pond. <br /> <br />Council Member Capra indicated she would not be in favor of a trail that zigzags around <br />Mr. Wilharber's property but would like to get the sidewalk on Dupre Road. <br /> <br />Council Member Broussard Vickers indicated that everyone on the east side has access <br />within the development to get to the north trail. She then said that the Planning <br />Commission made a recommendation on the lot combination, preliminary plat for Phase I <br />and the grading for Phase II pending approval of the Comprehensive Plan amendment. <br /> <br />Page 5 of 10 <br /> <br />I <br />/ <br />
