City of Centerville <br />Council Meeting Minutes <br />October 23, 2013 <br />rd <br />2. Mr. Rick Carlson Request to Reduce Developer Security, Hunters Crossing 3 <br />Addition <br /> <br />Mr. Carlson requested Council’s consideration of allowing him to reduce his letter of <br />credit to $10,000 and consider allowing him to make a cash security rather than a letter of <br />credit. Mr. Carlson stated that he anticipates providing the City with full payment of all <br />rd <br />outstanding special assessments associated with the Hunters Crossing 3 Addition prior <br />to November 15, 2013. Mr. Carlson stated that the Rice Creek Watershed District has <br />agreed to a similar arrangement relating to the development. <br /> <br />Discussion ensued regarding setting precedence, developers’ individual performances, <br />builders’ escrows, status of the development and amounts potentially needed to fund <br />building completion. <br /> <br />Motion was made by Council Member Paar, seconded by Council Member King to <br />modify/amend the existing developers’ agreement reducing the security to $10,000, <br />allow for cash funding rather than security funding through a financial institution <br />and contain language that if any amount of the cash security is utilized, it would <br />immediately be replaced by the developer, Mr. Carlson. All in favor. Motion <br />carried. <br /> <br />Mr. Carlson questioned the necessity of continuing the current letter of credit beyond the <br />November 15, 2013 payoff of assessments and $10,000 cash security. Administrator <br />Larson stated that once Mr. Carlson has complied with the above requirements, the City <br />would release the letter of credit in writing. <br /> <br />3. Kelly’s Korner – Renewal Application for Optional Liquor 2 AM <br /> <br />Mayor Wilharber stated that this is a routine item, that there have been no immediate <br />issues with Kellys’ liquor licenses and they are the only establishment that currently is <br />open until 2 AM. Council Member King expressed concern regarding noise emissions <br />from the establishment and ordinance policing by the Police Department. <br /> <br />Brief discussion was had regarding policing both by the establishment and the Police <br />Department, licensing requirements for On-Sale licensing, the Planning & Zoning <br />Commission’s review of the existing ordinance and possible language modification <br />recommendations. Mayor Wilharber stated that he would discuss the policing issue with <br />the Police Department and equipment utilized during enforcement. Administrator Larson <br />stated that he would discuss the matter with the establishment’s owners in an attempt to <br />reiterate their stewardship to the neighborhood and potential imposition of live event <br />regulations. <br /> <br />IX. ANNOUNCEMENTS/UPDATES <br /> <br />City Administrator Larson stated that the County would be holding an Open House for <br />the Centerville Road/CSAH21 Reconstruction Project tomorrow evening between the <br />Page 3 of 4 <br /> <br />
